Today, Governor Newsom signed two historic PAGA reform bills – Senate Bill 92 (Umberg) and Assembly Bill 2288 (Kalra). These bills collectively reform PAGA to ensure workers retain a strong tool for resolving labor claims and receiving fair compensation while limiting the shakedown lawsuits that negatively impact employers and employees. Did you know as many as 30 different pieces of legislation could impact on small businesses as part of Labour's workers rights reforms? From a right to switch off to banning exploitative zero hours contracts, and the introduction of rights such as sick pay and protection against unfair dismissal from the first day after a probation period, the Westminster government plans widespread changes. There will also be new rights for employees relating to parental leave and flexible working. This will require significant adaptation for all employers, but undoubtedly the biggest impact will be on many of the 300,000 small businesses in Scotland. That is a lot of change all at once for small enterprises, especially when many are already struggling with the demands of existing regulations. FSB research tell us more than one in ten spend eight hours or more a week on regulatory compliance. So, the starting pistol has been fired for the six-week sprint to a general election which will be held on 4th July. Issues like small boats, the NHS and the economy may dominate much of the headlines, but the outcome of the election will be of huge significance to employment law too, and therefore SME employers. We already know the trajectory of Conservative policy on employment law: a restriction on trade union activity; extension of the right to request flexible working; a ticking upwards of the National Minimum Wage and Living wage in line with Low Pay Commission recommendations; and the introduction of a week’s unpaid Carer’s Leave per year have been some of the recent initiatives. The most radical thing has probably been the post-Brexit shake up of who has a right to work in the UK. for anyone with too much excitement in their life, Andrew Speke and I have summarised the five main UK-wide political parties manifesto commitments on issues the High Pay Centre works on like pay and inequality, work and business governance TL:DR - Labour: some pretty major commitments on employment rights with the hefty caveat that they are subject to consultation. Not much on corporate governance - Tories: some quite important policies around shareholder say on pay and corporate reporting have been introduced over the past 14 years, but fair to say this area is no longer a big part of their lives. - Lib Dems: some quite interesting and thoughtful policies on corp gov. Will be interesting to see if the winning party picks this up post-election - Greens: ambitious plans to tax the super-rich more effectively, and again an extensive offering on workers' rights - Reform: issues like economic equality, responsible business and good work don't appear to be huge priorities.
