We will delve into Opinion No. 26 (2023) from the Consultative Council of European Judges (CCJE), which highlights the importance of maintaining judicial control over such oversight, rather than relying on external supervisory bodies mentioned in the AI Act. Yesterday, at the 133rd session of the Committee of Ministers in Strasbourg, the Council of Europe adopted the Framework Convention on Artificial Intelligence and Human Rights, Democracy, and the Rule of Law which is the first-ever international legally binding treaty on AI systems. Scope: The Convention covers the activities within the lifecycle of artificial intelligence systems that have the potential to interfere with human rights, democracy and the rule of law. The following are key commitments: ✔️Protection of human rights.- Art 4 ✔️Integrity of democratic processes and respect for the rule of law - Art 5 ✔️Respect for Human dignity and individual autonomy - Art 7 ✔️Equality and non-discrimination - Art 10 ✔️Privacy and personal data protection - Art 11 ✔️Remedies for human rights violations by AI systems - Art 14 ✔️Measures to combat risk and impact of AI - Art 16 ✔️Recognition of rights of persons with disabilities and children in AI - Art 18 ✔️Public consultation and promotion of digital literacy and skills - Art 19 & 21 ✔️International co-operation and cross exchange of information on AI for both inter and intra parties to the convention- Art 25 Overall this convention is a commendable document in the race for efficient AI regulation. #coe #AIconvention #humanrights #democracy

Artela Roshi, a fourth-year law student at the Department of Law, attended the @LAITECH2024, a two-day international conference organised by the TalTech – Tallinn University of Technology, and ILSA. The conference topic was “The Law, Ethics and Policies of AI and Future Technologies”. Artela presented her paper titled “The Use of Artificial Intelligence as a Tool of Truth-seeking in Transitional Justice in Post-communist Europe: The Case of Albania”. In her paper, Artela discussed from an interdisciplinary approach the transitional justice’s overlap with AI by taking as a case study Albania. Just a couple of months after the European #AIAct, the Council of Europe has adopted the first-ever international legally binding treaty to ensure human rights, the rule of law, and #democratic standards in the use of AI systems. This groundbreaking treaty, also open to non-European countries, creates a comprehensive legal framework for the entire #AI lifecycle, addressing risks and promoting responsible innovation. The Framework Convention on Artificial Intelligence and Human Rights, Democracy, and the Rule of Law was adopted during the annual ministerial meeting in Strasbourg on May 17th, 2024 and was developed by the Committee on Artificial Intelligence (CAI). The treaty includes input from 46 member states, the EU, 11 non-member states, the private sector, civil society, and academia. It covers AI use in both public and private sectors, emphasising transparency, accountability, and respect for equality and privacy rights. Today’s finalisation of the Council of Europe's Convention on Artificial Intelligence (AI), #HumanRights, #Democracy and the #RuleofLaw is a landmark. It is the world’s first legally binding instrument on AI and human rights, democracy and the rule of law. Leading up to today, Nele Roekens - our AI Working Group Chair and Legal Advisor at our member Unia – represented ENNHRI in this week’s final plenary meeting of the Council of Europe’s Committee on #AI where negotiations on the final text took place. She delivered a statement of concern to the plenary after the unveiling of the Convention’s final text. Indeed, while we welcome the finalisation of this timely and important Convention, we raised concerns at the meeting about the lack of essential safeguards in the final text. Some issues we raised were: 📌 The Convention should have covered both the public and the private sector equally. 📌 The Convention should have included AI systems used for national security. 📌 Essential elements of a human rights-based approach are missing, including clear and unambiguous criteria and examples of prohibited uses of AI. 📌 Imprecise language and insufficient robust and independent oversight bodies will make enforcement difficult. Such concerns have been echoed in statements by others, including the Council of Europe’s Commissioner for Human Rights, the EDPS - European Data Protection Supervisor, and Equinet, European Network of Equality Bodies.
