🔥 Italian Competition Authority (AGCM) enforces: 👉 the right to data protection 👉 transparency Re. decision to suspend social network accounts In particular, Meta did not indicate how it decided to suspend Facebook accounts: whether as a result of an automated or 'human' review  👉 Re. right to contestability: consumers should get relevant information regarding the possibility to contest the suspension of their account and enough time to contest (30 days not enough). 💥 EUR 3.5 million fine for Meta Platforms #Ireland Ltd. and its parent company Meta Platforms Inc. for unfair commercial practices regarding the creation and management of Facebook and Instagram social network accounts. CAIDP EUROPE applauds the action of the Italian Competition Authority ✅ rapid action, when the action of some data protection authorities (DPA) could be obstructed by lack of jurisdiction (Meta Platforms incorporated in Ireland so lead supervisory authority would be the Irish DPA and not the Italian one) and coordination among DPAs could take time ✅ effective sanction 🔑 Any resemblance with the rationale of the EU Digital Market Act (DMA) may or may not be fortuitous. The DMA aims to ensure that large online platforms behave in a fair way online and leave room for contestability.  It may or may not be a coincidence either that the AGCM has recently published a public consultation on the draft of the procedural rules concerning the use of its investigations powers for the implementation of the DMA, see https://lnkd.in/dDXdfs6B See the AGCM's press release here: https://lnkd.in/dCvvS4tm For more news, check out our website: https://www.caidp.eu/ Giuliano Borter Lina Chtioui Rose Boutboul Guido Scorza Marc Rotenberg Ursula Pachl Selim Alan Andrea Venanzetti Elisabetta Iossa Giulia Gentile
