The new Environmental Crime Directive has come into force. What does it mean? 💡 This directive provides a comprehensive list of serious environmental offences, including: Unsustainable water use ❌ Breaches of chemical and mercury regulations ☠️ Mishandling of fluorinated greenhouse gases Introduction of invasive species ❌ EU member states will now be required to establish these as criminal offenses in their national laws. This will ensure greater accountability and potentially harsher penalties for polluters who cause substantial environmental damage. The directive also strengthens enforcement efforts by providing resources and training for environmental authorities. No MileSTONE Unturned! Amidst some tricky environmental laws we have successfully assisted one of our dear clients in an appeal before the Water Tribunal – without making waves! The Water Tribunal directed the Department of Water and Sanitation (DWS) to issue our client with an integrated water use licence, authorising the development and operation of a mine residue deposit with an alternative barrier system to that which is usually prescribed by the DWS known as a Class C Barrier. 🌿 News for Environmental Protection in NSW! 🌿 The NSW Parliament has recently passed a significant piece of legislation that will strengthen environmental protection regulations in the state. This new law grants councils in NSW more power to enforce compliance and penalise those who breach environmental regulations. This is a significant step forward in safeguarding our natural resources. The Environment Protection Legislation Amendment (Stronger Regulation and Penalties) Bill 2024 enables councils to issue fines for illegal dumping. The fines for companies can be up to $5,000, while individuals can be fined up to $1,000. Repeat offenders may face double the penalty amount, and those who engage in dumping in sensitive areas may face even more significant fines. The New Environmental Crime Directive Comes Into Force on May 20th and replaces the 2008 Environmental Crime Directive. This groundbreaking law provides a comprehensive and up-to-date list of environmental offenses, addressing the most serious breaches of environmental obligations. It's a significant step towards achieving the European Green Deal objectives by fighting severe environmental offenses that endanger both environmental and human health. Key highlights include: • Introduction of new offense categories such as ‘serious breaches of EU chemicals and mercury legislation’ and ‘placing on the market and export of relevant commodities and products in breach of the Union Anti-Deforestation Regulation’. • Establishment of qualified offenses with severe penalties for substantial environmental damage. • Clear definitions of penalties for natural and legal persons, ensuring a strong deterrent effect across the EU. • Support and assistance for environmental defenders in criminal proceedings. UK #water companies have been found to have often discharged sewage into rivers and seas on dry days, which is illegal under environmental laws. Three companies, Thames WaterWater, Wessex WaterWater and Southern Water, were found to have released sewage for a combined 3,500 hours on days when it was not raining in 2022, according to an investigation by the BBC  Other companies may have also engaged in what is called 'dry spilling', but data was not available as there is an ongoing criminal investigation by the Environment Agency.  Water UK, the body that represents the industry, said the spills "should be investigated". Three major water companies illegally discharged sewage hundreds of times last year on days when it was not raining, the BBC investigation suggests.
