Picked this up at an event recently. Many persons with criminal records may be unaware of the provisions regarding fair chances to work that might exist in their areas. There are also several re-entry programs around the country, I actually volunteer with RISE (and highly recommend others volunteer too with them or another of your choice). It is also very important that immigrants with criminal records seek out advice as they move into various aspects of their lives, eg submitting adjustment of status applications or applications for citizenship. Someone might feel the offenses are "minor" and need not be disclosed to their Attorney or even USCIS. However, remember that if there is a paper trail of any kind (no matter how simple) following the issue, it is most likely that USCIS will become or is already aware. You will also be required to submit biometrics, which will include fingerprinting and that will no doubt show any interactions with the criminal justice system. Don't let bad advice or fear prevent you from getting your benefit. #immigration #criminallaw #reentrymatters

Q3 stats from USCIS are out. This might be a record-breaking year for the number of survivors of crimes applying for a U-visa. In the first 9 months of FY2024, there have been 31,011 Form I-918 petitions filed. That is almost as many petitions that were filed in all of FY2023! And because Congress capped the number of U-visas that can be granted in a year to just 10,000, the pile of pending petitions continues to grow. President Biden announced a new DHS policy to help U.S. citizens keep their families together. Eligible noncitizen spouses and children can apply for lawful permanent residence without leaving the country. Requirements include 10+ years of U.S. residence and legal marriage to a U.S. citizen. 📢 The Department of Homeland Security has announced a new policy called Keeping Families Together, which allows certain noncitizen spouses and stepchildren of U.S. citizens to apply for a process that could lead to lawful permanent residence without the need to leave the country. No justice; no peace. Know justice; know peace. When we vocalize these sentences, it is truly a surprise that they are indistinguishable?
Many people often wonder why I, a stalking victim, seem to give up more and more privacy as time goes on. Shouldn’t I be more and more reclusive? The short answer is that both are happening. I will address the obvious one. It started in smaller ways before I came to Quebec, but my most informative experience occurred during my border crossing. In contrast to traditional interrogation of asylum seekers when one makes a claim at a land border, I was asked the lock codes for all of my electronic devices. Instead of asking me questions in an in-person interrogation that I probably would have screwed up answering, the two CBSA agents spent at least twelve hours with my phone before talking to me at all. I slept in the lobby of the trucking crossing facility in Stanstead, Quebec with my dogs, who are legally prescribed to me as medical devices, while they scoured my electronics for ANY REASON to deny my very outrageous asylum claim (which, at the time, was also against COVID border policy), but this benefited me. Not only was my fear genuine, which was apparent from all of my communications, but I also save all the evidence electronically as well. They were able to review the evidence. And they also were able to see how incapacitated I had become as a result of the ongoing saga through my communications with friends. I don’t know if it is typical to help an asylum seeker fill out paperwork during their claim, but that was the only it was going to happen for me and I didn’t even have to ask for help. …and when I couldn’t answer verbally, they were very quick to offer me a pen and paper so that I could answer in a way that’s accessible to me. This is not the sort of behavior that I am accustomed to receiving from anyone in a position of authority, especially with law enforcement. For most, there is this one way and no one can deviate from it —even if it would literally kill me. Additionally, there’s a trend with the perception of my credibility wherein people who have read and reviewed my situation before talking to me about it are far more helpful than those who have not. (This is likely because of a widespread phenomenon among non-Autistic people where they mistrust Autistic people on a gut instinct level for reasons that they don’t understand — Google Scholar.) And, yes, I am a white woman. There’s no way to deny that these accommodations were likely more forthcoming as a result of my deficiency in melanin, but it was still the only accessible way that I could get through to this point in the process. Slowly, but surely, I am learning that, due cultural reasons beyond my control, the more transparent I am, the more people are willing to help. I respect that my strategy is counterintuitive, but I am loyal to the data, not the stereotype or an idealized performance of victimhood that even non-Autistic people with a large, local support network struggle to convey. Now you know! Please fill the people who do not like reading for me.

The Department Of Homeland Security (DHS) is taking steps to fulfill Executive Action announced by President Biden on June 18, 2024. To address this executive action, DHS will establish a new process to consider, on a case-by-case basis, requests for certain noncitizen spouses of U.S. citizens who: •Have lived in the U.S. for 10+ years •Does not pose a threat to public safety or national security •Are otherwise eligible to apply for Adjustment of Status •Merit a favorable exercise of discretion This initiative aims to strengthen family bonds and provide a fair pathway to Lawful Permanent Residence. #FamilyUnity #DHS #USImmigration #USCIS #ImmigrationLaw #StrengtheningFamilies

The USCIS announced via Twitter that there has been a notable reduction in the processing times for multiple forms. While the USCIS has acknowledged that there is room for improvement, we sincerely hope that the form I-130 for a US citizen's spouse or child is approved quickly. It is regrettable that a foreign spouse or child residing overseas must wait two to three years in order to join their U.S. citizen spouse or parent in the United States. The K-3 / K-4 option serves no useful purpose other than as an eye wipe. At the very least, premium processing for form I-129F (K3/K4) for a U.S. citizen's spouse or kid should be made available if the I-130 cannot be processed quickly. https://lnkd.in/gMaduuuZ
