Nick Baskett your post sums up the situation quite well and I see such clauses especially with SaaS and AI Providers. What I find quite problematic is the point that we might have to renegotiate contracts as these anonymisation clauses might lead to a JC relationship instead of a C2P relationship if the vendor does the anonymisation. This for sure leads to further audit and compliance measures you have to take into account. And usually the vendor does not have proper processes in place!

Many of the vendor contracts I see are now including provisions that allow Processors to use personal data they receive from us, as Controller, as they like, after they 'anonymise' it. However, when I ask for details on their anonymisation strategy, I get a blank, or they remove the clause, or I get a defensive response along the lines of 'we have X number of big companies that have agreed this clause'. If you use a de-identification framework, then show your homework, if you don't then please start. A back of a napkin explanation on how you aggregate and mask some elements is not proof of anonymisation, especially if the data is sensitive.
