According to a recent survey by the American Property Casualty Insurance Association and Munich Reinsurance America, most U.S. consumers are not. While 89% of respondents had seen advertisements for plaintiff law firms, more than half were unaware of third-party litigation funding. Additionally, 47% didn’t know a substantial share of jury awards and settlements go to attorneys, not plaintiffs. When taking in a new case, one of the most important things to consider is whether there are any damages and, if so, how much. If you're a Plaintiff, this is relevant because the amount of damages may not be more than the ultimate cost of bringing the suit. Plaintiffs need to understand this to make an informed decision about whether to proceed with the litigation. If you're a Defendant, damages are relevant because if a Plaintiff has not suffered any, then the Plaintiff may not be able to sustain their claim. This is because damages are usually an element of a claim.
