This year, during their supervision, the Labor Inspectorate will check, among other things, the fulfillment of the requirements for working and rest time. Due to the decision of the European Court of Justice, there have been many discussions recently about allowing an employee their weekly rest period. However, employers should also make sure that the legal requirements for daily rest time are met. It is overall known that every day lunch breaks should be provided to employees and that these breaks are not calculated as working time (with excpetions). In the case of both mentally and physically demanding work, the employer is obliged to allow the employee additional breaks during the working day or work shift that are included in the working time. As it is the employer's responsibility to take preventive action to avoid and reduce health risks, it is recommended to stipulate the additional breaks allowed by the employer and the procedure for taking them in the work organization rules. It is not in the employer's interest to add those additional breaks during the working day and shorten the working time or extend the lunch break at the expense of it. To avoid physical or mental overload and to fulfill the employer's obligation, breaks must be taken regularly, short breaks and more often than fewer and longer breaks.

Is near-shoring the solution? The impacts of strikes on the U.S. East Coast may also ripple through imports from China to Europe. The congestion created by this situation on both sides of the Atlantic could easily extend to trades with other regions, such as the Far East and South America. In the past month, the cost of shipping a 40-foot container from Northern Europe to American ports like New York or Houston has surged by nearly a third, as retailers scramble to mitigate the effects of industrial action. As the strike continues, companies dealing with time-sensitive goods are likely to redirect their cargo to ports such as Long Beach on the West Coast, where workers belong to different unions that are not participating in the strike. This strategic diversion is critical for maintaining supply chain fluidity and ensuring timely delivery of essential products. Christmas is here...
