Did you know that employment contracts made on or after 7 December 2022 cannot contain pay secrecy terms? Employees (and prospective employees) have a right to talk about their pay (and any terms and conditions necessary to work out their pay) with anyone if they want (or don’t want) to. Employers can’t take adverse action against an existing or prospective employee if they exercise this right. This is the biggest missed opportunity that I see more often than not when I review employment contracts… 📄 The absence of a pay in lieu of notice clause 💷❌🪧. Leaving them out of a contract comes at a cost for a business, particularly where it wants to move on quickly ⏱️. Worse, they’re often overlooked in favour of garden leave clauses 🪴, which don’t serve the same purpose at all. The Employment (Allocation of Tips) Act 2023, is expected to come into force 1 July 2024, which is a bit later than originally suggested. The Act will create a legal obligation on employers to allocate all tips, gratuities and service charges to workers, without any deductions, and to ensure these are distributed fairly between workers.
