In today’s virtual world, most people conduct their own research online for everything from law firms to coffee makers. Consequently, a negative online review has the potential to adversely affect, not only a business’s reputation, but also its viability. Because of that, it is only natural to want to defend oneself or one’s business when confronted with a review that one believes is inaccurate or derogatory. However, because lawyers are required to follow a specific code of ethics and are held to a higher standard than other professions, they need to proceed with caution when confronted with a negative online review. Disparagement, in legal terms, refers to the act of making false statements about a person or a business, which results in damage to their reputation or livelihood. Unlike defamation, which covers false statements damaging to one's personal reputation, disparagement focuses on statements harmful to business interests or products. 👩⚖️ Understanding the Nuances: 🟢 False Statement: For a claim of disparagement to be valid, the statement made must be false. 🟠 Third-Party Communication: The statement must be communicated to someone other than the person or entity disparaged. 🔴 Financial Harm: There needs to be a clear demonstration of financial loss as a result of the statement. 💡 Real-World Example: Imagine a competitor falsely claiming that a company's products are unsafe or made using unethical practices. What should legal and compliance departments do when faced with a single compliance complaint unsupported by evidence? In today's corporate landscape, companies with even a minimal compliance structure often rely on tools like hotlines and ticket submission portals to receive compliance complaints. These mechanisms serve as crucial channels for employees to raise concerns about potential misconduct. Yet, amidst these reports, a common dilemma arises: What should legal and compliance departments do when faced with a single compliance complaint unsupported by evidence? Unlike clear-cut cases with multiple substantiated claims, situations involving solitary whistleblowers present a unique challenge. Interestingly, neither laws nor governmental and internal corporate regulations offer explicit guidance on how to navigate such scenarios. Consequently, organizations find themselves at a crossroads, torn between initiating costly investigations that may strain professional relationships or opting for passive monitoring or inaction. However, delving into ancient wisdom, particularly Jewish law, sheds light on this ethical conundrum. The Torah, in Deuteronomy 19:15, prescribes, "one witness shall not rise up against a man for any iniquity or for any sin." From this directive emerges a fundamental principle: it is forbidden to impose punishments or sanctions based solely on the testimony of a single witness, regardless of their credibility. While punitive measures cannot be enforced, Jewish law allows for the investigator to ask the accused to assert their innocence. Subsequently, should the initial accusation be substantiated, the severe consequences for falsely denying the allegation are also imposed.
