Very relieved about the result achieved for a decent businessman-client involved in a traffic accident with a tragic fatal outcome. Working closely with a team of senior and junior counsel, we successfully secured a non-custodian sentence, a Community Service Order (CSO), alongside other penalties. The trial judge acknowledged the client's genuine remorse, leading to this favorable outcome (see e.g. paras. 32 - 37). CSO plays a crucial role in criminal cases, significantly impacting defendants' liberty based on individual circumstances. In a contrasting case, a defendant received an 8-month imprisonment sentence for causing injuries with a wine glass. Lack of remorse influenced the judge's decision (https://lnkd.in/gUg4Kr3j, at para. 13), highlighting the importance of genuine contrition in legal proceedings. This experience resonated with a motto from my early law career, emphasizing the delicate nature of civil and criminal litigation, akin to walking in a minefield. Reflecting on these cases underscores the complexities and nuances of legal practice, shaping outcomes based on various factors.
