I shared my thoughts on the Legislature's proposed expansion of New York's wrongful death statute in an article published today in Law360. https://lnkd.in/giJCKxRf If signed by Gov. Kathy Hochul, S.6636 would significantly impact litigation strategy, trial costs, and place additional burdens on court dockets statewide. Critics of the legislation have voiced concerns that, in its current form, S.6636 would have vast financial repercussions, as the cost of insurance premiums in New York would climb according to data compiled by an actuarial firm and would impact medical costs and accessibility to care. The bill's retroactivity provision also raises potential due process concerns, as it would impose new legal obligations regarding past events -- an issue examined by the Court of Appeals in Regina Metro. Co., LLC v. New York State Div. of Hous. and Cmty. Renewal, 35 N.Y.3d 332, 379 (2020) (striking down as unconstitutional various legislative changes that applied retroactively).
