CAA Section 201: Gag Clause Attestation Truth: Employers who sponsor a group health plan are required to comply Truth: Attestation is due by December 31st of 2023 Truth: Failure to comply may result in a penalty of $100/day per impacted individual Truth: Health plan partners (Carriers/Networks/etc) have no requirement or incentive to comply False: Keeping compliant is hard How do I? 1. Ensure your plan has NO gag clauses, ideally with your own eyes, before attesting 2. Complete Attestation and/or complaint as needed, hint: a good compliance attorney or benefits advisor can be a huge asset here 3. Time is running out. This year's deadline for employers with group health plans to submit their gag-clause attestations is literally hours away. What exactly are we talking about? The Consolidated Appropriations Acts of 2021, legislation that imposes all kinds of new fiduciary obligations on employers, including one requiring them to attest that their contracts with service providers include no gag clauses. The CAA's gag clause prohibition was designed to ensure patients have the information they need to make informed decisions about their care. Lots of employers are relying on insurers or third-party administrators to help them with this. Our advice? Get everything checked by your benefits broker or lawyers. You want an objective assessment on this, because, as we've said before, regulators and class-action law firms that specialize in chasing errant employers are closely watching this.
