CAA Section 201: Gag Clause Attestation Truth: Employers who sponsor a group health plan are required to comply Truth: Attestation is due by December 31st of 2023 Truth: Failure to comply may result in a penalty of $100/day per impacted individual Truth: Health plan partners (Carriers/Networks/etc) have no requirement or incentive to comply False: Keeping compliant is hard How do I? 1. Ensure your plan has NO gag clauses, ideally with your own eyes, before attesting 2.
