‼️ We need your help to protect access to legal action for Florida’s waterways. ‼️ The Florida Legislature is trying to strip us - conservation organizations and concerned citizens like yourself - of the power to go to court to enforce environmental laws. Senate Bill 738 and House Bill 789 (entitled 'Environmental Management') would require the losing party in many environmental lawsuits to pay the court costs and attorney fees of the other parties. This is an attempt by the legislature to stop Waterkeepers and other groups from challenging environmentally destructive permits by threatening us with financial ruin. An environmental advocacy organization on July 23 filed a lawsuit against the City of Los Angeles over the Port of L.A.'s stormwater treatment system. This year is expected to be a tough one when it comes to wildfires. The Environmental Law Institute (ELI) and the EPA recently released a report entitled "WIldfire Smoke: State Policies for Reducing Indoor Exposure." It includes information on emergency planning, guidance on outreach and education, and policies on material assistance for residents. On March 15, 2024, a Sacramento Superior Court judge upheld the State Water Resources Control Board's Substitute Environmental Document (SED) for the Phase I update to the Water Quality Control Plan for the San Francisco Bay/Sacramento-San Joaquin Delta Estuary, also known as the Bay-Delta Plan. The SED aims to protect native and migratory fish in the San Joaquin River and its tributaries while easing standards for South Delta crops. Downey Brand counsel Austin Cho and associate Jake Voorhees provide an overview of the court's ruling, which after considering 116 claims, found no violations of key environmental laws such as #CEQA or the public trust doctrine - a significant victory for the State Water Board as it progresses with Phase I plans and Phase II updates to flow objectives in the Sacramento River and Delta watershed. The Environmental Protection Agency (EPA) is facing challenges in investigating and acting on environmental justice issues under the current US government. A proposed overhaul of Louisiana Department of Environmental Quality’s pollution permitting was dropped last year after a lawsuit challenged the mechanism the EPA was using to prove Cancer Alley residents were being discriminated against due to the disparate impact standard. This standard allowed the EPA to look at the facts about demographics and exposure to carcinogens and infer that Black residents were being disparately impacted by pollution compared to white residents. The loss of this standard has had a chilling effect on the EPA’s civil rights investigations and environmental justice issues under President Biden. The investigative pattern has dropped and looms over other states, including Michigan. It is a challenge to the regulatory program as the EPA is mandated to ensure entities given federal money don’t discriminate on the basis of race, color, or national origin.
