Michael Bradley. Marque Lawyers An organisation with just two people (Michael Bradley being one) on the board (apart from Grace Tame) and an advisory panel of just one person (Michael Salter) who also is a member of the board. Why call it an advisory panel when it is just one person - have they ever thought of advisor? Why have it when that ‘advisory panel’ is also a board member? Apparently over 50% of the revenue is spent on legal fees which is not within its stated ‘intentions’ - read the article to pick up the flavour of this. And annual accounts are always lodged late - so find out about FY 23 in May 24??? Maybe UNSW Business School can tell us about this in terms of good governance practise. Maybe Marque Lawyers or UNSW Law can tell us about this in terms of good legal practise.

Setting up investments under trust or investments that can attract Business Relief (BR) and gifting, are three possible considerations when providing advice to clients on how to properly plan their estate to protect assets and mitigate inheritance tax (IHT). Although a client who lacks mental capacity cannot settle a trust, their attorneys or deputy can, on behalf of the client, make larger investments attracting BR and/or gifts (including to themselves) but only if it can be unequivocally demonstrated that in doing so so, the client’s (donor’s or P’s) own lifelong financial position is not jeopardised and their later life needs are fully met. For larger gifts that are not permitted under s.12 of the Mental Capacity Act 2005, a Court order will be required and, in the case of BR investments, is recommended, before implementation. This article by Mary Rimmer TEP of Brachers LLP clearly explains gifting on behalf of a client who may have lost mental capacity. This article from the The Association of Lifetime Lawyers, which has been written by Mary Rimmer TEP of Brachers LLP, provides a very clear explanation of what a deputy or attorney can or can’t do in terms of gifting on behalf of the donor or P. The issue of gifting is invariably a key component of the advice that we provide to clients who are seeking to plan their estate and pass wealth to their families, but recognising the need to meet later life needs and comply with the requirements imposed under the Mental Capacity Act 2005 (MCA). Our team has the specialist knowledge and qualifications to support lawyers in making applications to the Court of Protection for gifts that are outside the scope of s.12 of the MCA and ensure the inherent conflict between estate planning and later life care fees planing is properly reconciled for the client.
