See publicationThis paper analyzes the history of the Semiconductor Chip Protection Act (SCPA) 17 U.S.C. §§ 901-914 and inquires into why it is seldom used in IP litigation. Afterwards, this paper makes the argument that the SCPA should be used more in IP litigation, perhaps in tandem with patent litigation, and can be a viable form of protection for semiconductor microfabrication firms or integrated circuit companies engaged in cutting-edge designs.

The USPTO has issued a notice of potential exposure of protected patent application information through Patent Center. According to the USPTO: "On August 1, 2024, a stakeholder notified the USPTO that a limited amount of protected information within Patent Center was potentially accessible to the public, through certain search functions on the Assignments page. That same day, the assignments functionality within Patent Center was disabled to prevent any further potential exposure." The USPTO further notes the following: "Any improper access of the application information between the dates of December 2, 2017, and August 1, 2024, is not considered a publication of such applications under 35 U.S.C. 122(b). No rights in U.S. patents are threatened by this limited access to unpublished patent application information. While it is unlikely that the title could disclose the invention in a way that would constitute patent-defeating prior art in any jurisdiction, to the extent any issue is raised, the USPTO will assist applicants by confirming that the disclosure was erroneous and inadvertent." Contrary to claims that it is a tactic to dodge creditors, the Texas two-step aligns with both bankruptcy and corporate laws, providing an equitable solution to handle mass tort litigations like asbestos claims efficiently. This process, established by the Texas corporate law, allows companies to split their assets and liabilities between two entities. The newly formed subsidiary handling liabilities can then file for Chapter 11, transforming tort plaintiffs into creditors. This method not only ensures fair compensation through established trusts but also maintains the financial health of the original company, allowing it to continue operations. Roman highlights that the Texas two-step is not only a legitimate legal strategy but also one that supports the fundamental principles of federalism by respecting state corporate statutes and integrating them into federal bankruptcy proceedings. The process is bolstered by strong federal statutes like 11 U.S.C. Section 524(g), which was designed to facilitate global settlements for mass tort claims, emphasizing the need for a majority claimant approval and the creation of settlement trusts. Adobe Gets E-Signature Patent Claims Erased as Ineligible at CAFC On Wednesday, July 3, the #US. Court of Appeals for the Federal Circuit (CAFC) affirmed a district court's decision that an e-signature #technology #patent was ineligible under Section 101. The district court determined that the patent claims were addressed to a longtime business practice under Alice step one, and hence abstract, and that they had no inventive step at Alice step two. Judge Prost wrote the #CAFC opinion. e-signature #Software, LLC has #US #Patent No. 8,065,527, which is titled "System and Method for Embedding a Written Signature into a Secure #Electronic Document." #Adobe, Inc. sought for judgment on the pleadings, arguing that the claims were inadmissible under Section 101. E-signature opposed. Following oral arguments, the U.S. District #Court for the Northern District of California determined that, in evaluating the claims under Alice step one, E-signature acknowledged that "signatures have been used for centuries to notarize and authenticate documents," and that the claims ultimately "simply recite that existing business practice with the benefit of generic computing #technology." The Federal Circuit's opinion clarified: "E-signature's argument misunderstands both the district court's rationale and the applicable case law. The district court did not find that using digital signatures in an electronic document was a longtime business practice. It did not need to. Instead, it concluded that signing documents in specific places was a historical corporate practice—and that claim 1, because of its merely functional and general implementation, amounts to little more than saying, "Do that on a #computer." Lastly, E-signature contended that the district court ought to have interpreted certain terms in the #claims before declaring them #ineligible; however, the #CAFC dismissed this argument as "unpersuasive" since it failed to provide any justification for why a particular interpretation under Alice would be advantageous.
