I’m proud to announce the new 12th edition of Black’s Law Dictionary, now available from Thomson Reuters. This new edition boasts over 2,500 new and updated entries, including many reflecting the growing intersection of law and technology in our digital age. Take, for instance, “biometric identification.” This technology, dating back to 1982, offers a secure way to confirm one’s identity using unique physical characteristics. From facial recognition to fingerprint scanning, biometric identification is revolutionizing legal proceedings, especially in areas like forensic investigation and data privacy. At the opposite end of the discourse around digital identity, we see identification replaced with deception. A “deepfake” is a false audio or video recording, often created using so-called artificial intelligence and intended to deceive. It counterfeits a person’s likeness or voice in scenarios that never happened. Often employed to sway the court of public opinion, this technology is appearing more frequently in cases before state and federal courts, challenging traditional legal standards of authenticity, proof, and evidence. Deepfakes represent one particularly pernicious and libelous form of “cybersmearing,” a term describing digital defamation. It involves spreading disparaging statements on websites or social media, causing damage that extends well beyond the digital realm. And cybersmearing itself falls within the broader context of “digital abuse,” an increasing social and legal concern, which includes various forms of harassment, bullying, stalking, and intimidation carried out on digital platforms. But on the flipside of digital fraud, someone claiming to the be victim of digital abuse may actually be suffering from “factitious disorder by internet,” once called “Munchausen syndrome by internet,” which leads someone to feign victimhood or illness online, sometimes for the attention and sympathy—but sometimes with the aim of fraudulently soliciting donations. Collectively, these terms exemplify the emerging legal challenges of our digital age, with implications for cybercrime and fraud legislation. As legal professionals, it’s vital that we stay abreast of terminological changes. Today we conclude our five-week tour of the newly revised and expanded 12th edition of Black’s Law Dictionary, available now from Thomson Reuters. It’s replete with over 2,500 new and updated entries, reflecting our endless quest to make Black’s the most accurate, relevant, and comprehensive law dictionary in English. Moving up the chain from last week’s focus, legislation, we’re looking this week at five terms related to government: “authoritarian,” “kakistocracy,” “political speech,” “popular sovereignty,” and “totalitarianism.” While “authoritarian” and “totalitarianism” refer to systems of government where power is concentrated in the hands of an individual or a single political party, “popular sovereignty” describes a system where the majority of citizens’ preferences are reflected in the government’s policy choices. What some call popular sovereignty, an authoritarian might call “kakistocracy.” Perhaps a lesser-known term, this word describes a government run by the least qualified (or most unscrupulous) citizens. Such differences of perspective are inherent in “political speech,” which the U.S. Supreme Court has stated is “at the heart of the First Amendment’s protection.” Political speech “protect[s] the free discussion of governmental affairs.” As we saw in Week 2 with the “imminent-lawless-action test,” the discourse and legal landscape surrounding free-speech issues are evolving even today, and an up-to-date law dictionary is an essential tool enabling you to stay current in your practice. The new edition’s value lies not only in understanding and interpreting the complexity of law but also in shaping its evolution.
