APPEALS COURT RULES PART OF A FLORIDA PRETRIAL RELEASE LAW UNCONSTITUTIONAL On Wednesday, July 24th, the 3rd District Court of Appeal ruled 2-1 against a 2023 Florida law altering pretrial release conditions for those accused of crimes, citing constitutional overreach. A portion of the law states that “A person arrested for a dangerous crime may not be granted nonmonetary pretrial release at a first appearance hearing if the court has determined there is probable cause to believe the person has committed the offense.” Judges sided with Giselle Romero and Wachovia Middlebrooks, arrested in March on misdemeanor domestic-violence charges, who were denied nonmonetary pretrial release under the law. Judge Kevin Emas, with Chief Judge Thomas Logue concurring, argued that the law violated the Florida Supreme Court’s exclusive rulemaking authority over procedural changes. Judge Norma Lindsey dissented, deeming the case moot as both defendants were released. Emas highlighted the recurring nature of the issue, noting ongoing related cases and a committee’s recommendation for a rule change to the Supreme Court. The appeals-court majority opinion, written by Judge Kevin Emas, said the Florida Supreme Court in 2005 rejected a similar law because it “violated separation of powers principles by infringing on the exclusive rulemaking authority” of the Supreme Court. “In sum, an arrestee’s substantive right to a probable cause determination is well-entrenched, grounded in the United States and Florida Constitutions, recognized a half-century ago by the United States Supreme Court, and governed by a procedural rule promulgated by the Florida Supreme Court,” Emas wrote in the decision joined by Chief Judge Thomas Logue. https://lnkd.in/eXwBpNBj #lawyer #lawyers #legalnews #appeals #attorney #attorneys #law #tampa #clearwater #stpete #sarasota
