Firstly, this book analyzes borrower’s over-indebtedness in the private sector and suggests a multidisciplinary approach to deal with this problem based on: bankruptcy law, civil procedural law; for mortgage execution and credit reporting systems. Secondly, it examines how financial institutions evaluate credit risk and its impact on the cost of credit based solely on information held by lenders on their own clients. It is believed that the current assessment of creditworthiness is problematic without an effective credit reporting system and as such, this book also analyzes the consequences that result from their failure.
The second part of the book focuses on credit reporting systems. In particular discusses aspects related to data sharing restrictions imposed by data protection framework as regards to positive information files collected by credit bureaus and the exceptional regime of the credit register. Finally, it takes a close look at international experience related to credit reporting systems to ascertain systems that could be of benefit to a wider economic community. In sum; the book analyses personal insolvency and discusses factors that should be taken into consideration to mitigate such situation from a broad perspective.
