Judge blocks plans for sports joint streaming venture among Fox, ESPN And Warner Bros.Discovery. The launch of Venu Sports will be delayed after a federal judge granted FuboTV's request for a preliminary injunction against the proposed venture between ESPN, Fox and Warner Bros. FuboTV filed the lawsuit two weeks after ESPN, Fox, Warner Bros. Discovery and Hulu announced they planned to launch a sports-streaming service. United States District Judge Margaret M. Garnett in the Southern District of New York said in her 69-page ruling that Fubo was likely to succeed in proving that the joint venture would violate antitrust laws and that Fubo and consumers "would suffer irreparable harm absent an injunction”. FuboTV said in its filing that it has tried for years to offer a sports-only streaming service but has been prevented from doing so by ESPN. Fox and Warner Bros. Discovery have imposed bundling requirements on FuboTV that Fubo claims force it to spend hundreds of millions of dollars to license and carry content that its customers do not want or need. Venu Sports announced on August 1 that it would be available for $42.99 per month with a planned launch in the autumn. The platform would include offerings from 14 linear networks - ESPN, ESPN2, ESPNU, SEC Network, ACC Network, ESPNEWS, ABC, FOX, FS1, FS2, Big Ten Network, TNT, TBS, truTV - as well as ESPN+. Subscribers would have the option to bundle the product with Disney+, Hulu and/or Max. Streaming platforms and broadcasters need to find a way to share this content without litigation, without disputes. This cake can be sliced into many pieces, and each content provider can make money and give their subscribers and viewers satisfaction and what they really want to watch. This situation could be the start of a debate on the right to watch sport. A few questions came to my mind. Events such as the Olympics, the World Cup, the EURO and many others belong to society. Citizens pay taxes and national teams are largely sponsored by their money. Shouldn't that mean they have the right to watch games and athletes representing their countries or states for free wherever they want? Isn't it a kind of human, constitutional right to have access to this entertainment? We can be sure that TV channels and streaming platforms will fight for every profit opportunity. But sport is different, it makes people happy, it brings families, communities, states, countries, the whole world together. The market has to find a way, a solution to this problem, it won't be easy to balance cost and profit and people's enjoyment, but I strongly believe it can be done. Rich Greenfield, it's premature to call the Disney/Charter distribution deal a failure. Their "bundle" combines separate Disney products but falls woefully short of meeting consumer needs. I have yet to meet an NFL fan who only cares about the football games that air on ABC and ESPN. As compelling as the Disney programming may be, sports fans want to watch all games, irrespective of the network or streaming service. We should not view the adoption of the bespoke Disney bundle as the measure of the deal's success. The true measure is whether other legacy media companies adopt this deal template to create a comprehensive "full streaming bundle" distributed through pay-TV operators, including Disney+, Hulu, ESPN+, Max, Discovery+, Paramount+, Peacock, and Fox programming. I believe legacy companies' long-term success will largely hinge on their ability to roll out these "full streaming bundles" through pay-TV operators as quickly as possible. The cutthroat power struggle within US Soccer is plunging the sport into a downward spiral, with MLS at the forefront of the controversy. This calculated move by MLS comes as no surprise, considering its ongoing assault on the USL's modest strides in lower league soccer. The recent demise of USL San Diego serves as a grim reminder of the ruthless tactics employed by MLS to crush any potential competition. Such ruthless maneuvers not only stifle the growth of the sport but also erode the very essence of healthy competition that soccer thrives on. MLB gets it right. Today, for the first time in the history of the game, stats from the Negro Leagues can be seen right next to stats from the entire history of MLB. Since MLB didn't integrate until 1947, there is an entire history of outstanding players who never got the broad-based respect and admiration they deserved. The risk is that their stories and achievements would be lost to time. That would be tragic, a loss to American history. This move makes it possible for children to ask questions like: "who was Satchel Paige and why is he ranked among the all-time lowest ERA pitchers?" Or even "why does Josh Gibson have a higher OPS than Babe Ruth, Ted Williams or Lou Gherig?" These questions have profound implications. They make it possible to have honest conversations about our collective and difficult past. Hat tip to the leadership at MLB, and so many others, who have done the hard work of collecting, culling and verifying the stats from the Negro League era. Hat tip to Ken Burns for including stories from the Negro Leagues in his outstanding Baseball documentary series. Given the popularity of sports documentaries, I think it's only a matter of time before we hear some of the most powerful stories in the history of sports... coming from the era of the Negro Leagues.
