Until this last week, it's gone into a folder labelled "to read", where it joined too many other interesting newsletters that I also haven't had time to read and then promptly neglected. I've spent a career as a knowledge service provider of one kind or another, and I've recently started thinking about ways to fine tune things, specifically in terms of actual and potential intersections between #AI, #law and other #appliedresearch fields. So... that means reading more than just the headlines. There's a ton of material to digest. Bear with me, and take my notes below with a grain of salt, as they're informed in part by my relative newness at engaging with all the chatter about AI. ** A couple of recent bits flagged in #Brainyacts caught my attention. - COSTS: A law firm invested serious money in developing its own in-house AI tool, and in testing it saw a corresponding "displacement" of 6000 billable hours. This doesn't amount to a "loss" of billable hours - more like the ability to work that volume of legal matter and bill the corresponding hours at a much, much faster rate. Make of that what you will about possible future billing models... The study found significant differences in hallucination rates between #LexisNexis, #ThomsonReuters, and #PracticalLaw AI products, as well as #ChatGPT4. Lexis came out on top. What I thought was interesting was just how reliable or accurate the more highly rated tools were found to be. Tell me about a deal you've lost because of legal. I know you have stories, painful ones. You steer a customer through RFP, demo, more demos, budget, security and compliance only to have the deal die "in redlines." It's excruciating. Yet, honestly, what do we expect? No matter how good your legal team or particular lawyer, the process itself is basically a designed fail. We start with a fight over who's paper to use and then it only goes downhill from there, with the losing company often having to redline nearly the entire agreement just to get back to balance. In other words, we use an adversarial process where one party gets tripped out of the gate and then wander around wondering "why oh why is this always so awful?" Yet, interestingly, ask either party before the deal starts and they'll be able to tell you nearly exactly where the terms will land, if only the process itself doesn't kill the deal first. Would you rather be a vitamin or a pain killer? That’s the discussion Alex Su and I have been having about flex legal talent Since Alex entered the flex talent world, we’ve been having this debate. Actually, we first discussed it before he joined the dark side, but I digress. Today, flex talent is primarily viewed as a painkiller. There’s a gap, a leave, an absolutely absurd amount of work, a special project with no internal resources to support, etc etc and clients come to us to fix their pain, immediately. And we do that, and we do that incredibly well here at Paragon Legal. It’s fulfilling to be able to provide relief, and it makes for a wonderful business. We also have a subset of clients who use our service like a vitamin. Is this less exciting and takes more thought? Yes, 100%. It takes preparation & planning. It’s a strategy that avoids the adrenaline rushes and the highs and lows. There is no “immediate relief” because there is nothing to need relief from. These clients plan with us, and think about their staffing and rightsourcing ahead of time. We help assess their current state and they work with us on a decision matrix on when to hire, when to flex, and when to go to OC. We are ahead of their needs by months. And we help them capture huge savings & efficiencies not just in their legal team, but in supporting the business. We are the daily vitamin to support healthy activity (or whatever the One-A-Day slogan is). So, yes, we do both. We are a service that is a painkiller and a vitamin. My lofty goal is to educate so more legal departments take their vitamins. That’s where the true value is, however boring it may seem. And we are ALWAYS here to be the painkiller because we know, even with the most careful planning, legal has a way to keep us in our toes. #inhousecounsel #legalops #flextalent
