In a recent article for New York Law Journal, Caroline Hickey Zalka, Aaron Curtis and Brian Kitchen discuss how courts adjudicating securities litigations have split over whether the statute of repose runs from the date of the last alleged misstatement or from each alleged misstatement individually. Statutes of repose offer much stronger protections than statutes of limitations, but the point at which the statute of repose begins to run is often the determining factor in whether it can be used as an effective defense in securities fraud cases.
