While only published cases “bind” lower courts, unpublished cases hold significant weight due to the “inter-panel accord doctrine,” influencing even unpublished decisions unless clearly distinguishable. Criminal Cases of Note: Barnes v. Com.: Reaffirmed that minimal corroboration is needed for co-conspirator testimony. Brawner v. Com.: Required court to inform Brawner about the option of community service instead of just paying court costs. Jackson v. Com.: Probationer's contesting violations cannot be used as an aggravating factor in sentencing. Bates v. Com.: Past relationship evidence deemed too speculative for sexual assault claims. Civil Cases of Note: Stafford Board of Zoning Appeals v. Grove: Demurrer is a valid response in BZA appeals. Hamilton v. Jackson: Emphasized precise assignment of errors for appeal viability. Cascade Creek Homes v. Chesterfield: Legal costs do not cover attorney fees or mediation. Jones v. Kim: Affirmed punitive damages for willful negligence. Domestic Cases: Bobocholov v. Last week, the Court of Appeals found that police had the ability to enter private property to detain an individual for a traffic infraction. When the individual resisted the detention because he was on private property, police deployed pepper spray. The Court of Appeals affirmed his conviction, finding any error was harmless. In civil cases, the Court of Appeals confirmed that medical malpractice and worker's compensation proceedings have different burdens of proof, with worker's compensation having a lower burden. Last week the Court of Appeals of Virginia reversed criminal convictions in 2 separate cases, stating that the Commonwealth failed to introduce evidence on required elements of the crimes. Jurors and judges thought these men were guilty, but the Court of Appeals acquitted them. The Court of Appeals also reversed the imposition of a new term of probation on a man originally sentenced over 10 years ago, finding that the General Assembly specifically limited a circuit court's ability to impose terms of probation. A lot of new civil opinions came out last week, too, with the Court of Appeals reversing the circuit courts in several cases. Make sure your legal team knows the current state of the law.
