Unlike litigation, parties can choose to enter into binding or non-binding arbitration. In non-binding arbitration, if either party disagrees with the arbitrator’s final ruling, they can choose to take their matter to court. The parties are not bound by decision. In binding arbitration, the parties choose to accept the decision of the arbitrator as legally binding and enforceable. The arbitrator’s decision is final and ends the dispute. The Child Support Guidelines Do Not Always Apply In High-Income Divorces In situations where the combined net income of the parents exceeds $187,200 per year, the court shall first apply the child support guidelines up to $187,200 and then supplement the guidelines based award with a discretionary amount based on the remaining family income (i.e., income in excess of $187,200) and the factors specified in N.J.S.A. 2A:34–23. Thus, the maximum guidelines award represents the minimum child support award for families with net incomes of more than $187,200 per year. The court shall not extrapolate the guidelines for the purposes of calculating the supplemental portion but rather uniquely tailor it based on the financial circumstances of each matter and the specific needs of the children involved. To tailor the child support obligation, it is necessary to create a budget specifically for the child’s expenses and determine the child’s reasonable needs.
