    📣 It’s October 1, which means three new US privacy laws are now in effect! 1️⃣ The Montana Consumer Data Privacy Act (MCDPA): One of the stronger state privacy laws on the books, the MCDPA has a lower threshold for applicability (50,000 vs. the more usual 100,000), requires opt-in consent for processing sensitive personal data and the data of known children, and requires businesses to recognize and honor universal opt-out mechanisms, such as the Global Privacy Control (GPC). 2️⃣ The Maryland Age Appropriate Design Code Act (MAADCA): Under this law, businesses must complete DPIAs for existing products by April 1, 2026, implement high-privacy default settings for children, provide privacy information in age-appropriate language, and adhere to a "best interests of children" duty of care. Unlike the (now partially enjoined) California version of this law, the MAADCA does not require an explicit age estimation requirement or mandatory age-gating of products. 3️⃣ SB3 (Children’s privacy amendments to the Connecticut Data Privacy Act): Applying to businesses offering online services to consumers under 18, SB3 imposes strict restrictions on the processing of minors' personal data, including bans on targeted advertising, selling data, and certain profiling activities. Companies must ensure data collection is limited to what is necessary, conduct data protection assessments, and implement clear consent mechanisms that are free of dark patterns.     I had the pleasure of speaking briefly at IAPP’s #PSR2024 this week, to introduce Jenn Louie. It was an incredibly rich 3 days of conversations (as it always is) and in my remarks, I wanted to try to capture the moment we’re at right now both as practitioners, and technology partners supporting those practitioners. As I shared, we face a critical choice as privacy matures into a more complex and more technical discipline: Should we simply chase compliance with every new regulation and platform development, or do we need to take a step back to examine our broader privacy postures, and whether we’re acting in the best interests of our customers and their data? This question is especially relevant as AI governance enters the spotlight, with nearly 70% of CPOs now taking on these additional responsibilities, according to IAPP’s recent Organizational Digital Governance 2024 Report. I emphasized the importance of not getting completely distracted by shiny new things, but instead using innovation moments to re-evaluate what we know matters most in privacy: what data we're collecting, what’s been consented to, and how we're protecting the rights of the most vulnerable among us. Because when innovation starts and ends with privacy—where privacy isn’t just a checkbox, but a core part of the mission of our companies, with systems and cultures that don’t just comply, but set a new standard of innovation—anything is possible. I want to extend my gratitude to Jenn for her insightful talk on how technology intersects with our moral responsibilities. Her work is a reminder that innovation should always prioritize consumer choice and respect privacy as a core mission.
