About us
Our Mission The Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics at Harvard Law School was founded in 2005 through a generous gift from Joseph H. Flom and the Carroll and Milton Petrie Foundation, with the goal of promoting interdisciplinary analysis and legal scholarship in these fields. The Center is not an advocacy organization, but rather is dedicated to the unbiased analysis of pressing questions facing health policymakers. The future promises to raise new and fascinating issues that will make these interdisciplinary analyses all the more important. Scientific advances are pushing the boundaries of existing thinking on everything from what defines a human life to what constitutes an ethically tenable area of research, as well as raising complex issues about the appropriate role of intellectual property. At the same time, transformations in health care financing and business practices, changes in the role of health law, and the growing realization that the environment has a direct link to human health have upset traditional professional and market paradigms. The founding vision of the Petrie-Flom Center is to promote scholarly inquiry that breaks away from existing disciplinary lines and brings the totality of these disciplinary methodologies under its compass to inform policy. To achieve this goal, the Center fosters a community of leading intellectuals, practitioners, and policymakers from a variety of backgrounds and at all stages in their careers. “Given the growing demand by both physicians and patients to provide and receive care irrespective of geographic location, there is a pressing need to offer a pathway that allows for interstate telehealth practice. The Interstate Medical Telemedicine Registration Compact (IMTRC), proposed by Harvard Law School in a consensus statement for telehealth licensure reforms, aims to achieve this by enabling licensed physicians in good standing in one state to register with a centralized, national compact to practice telehealth in all participating IMTRC states.” Rounding up the #BillOfHealth Digital Symposium on #FutureOfTelehealth, Tara Sklar of University of Arizona, James E. Rogers College of Law, argues the need to pursue an interstate medical telemedicine registration compact. IN 1 WEEK: Join us for our first seminar of the academic year, "Commercialization of Traditional Knowledge and Justice for Communities" on September 13, 2024 at 12:30pm Eastern Time, live on Zoom. Register here: https://lnkd.in/ecTWrb2i Traditional knowledge, often from indigenous communities, has sometimes been patented and commercialized, raising concerns about who benefits from knowledge, patentability, and the co-option of communities’ knowledge or practices, sometimes referred to as “biopiracy”. In May 2024, the World Intellectual Property Organization – WIPO issued new guidelines on genetic resources and traditional knowledge and a new treaty that could be the start of new international trade and #intellectualproperty protections for #traditionalknowledge. In this session, we will explore the #ethics of commercialization and #justice for communities that share their knowledge. Presenters include Nicole Redvers, ND, MPH, DPhilc, Associate Professor, Schulich School of Medicine and Dentistry, Western University (Canada), and Angela R. Riley, JD, Professor of Law, UCLA; Director, Native Nations Law and Policy Center; Justice, Supreme Court of the Citizen Potawatomi Nation. Moderated by Daniel Eisenkraft Klein, PhD, Program On Regulation, Therapeutics And Law (PORTAL), Brigham and Women's Hospital and Harvard Medical School. Support provided by the Oswald DeN. “As doctors treating rare cancers during the pandemic, we were initially skeptical that a tiny camera in a patient’s home could replace a clinic visit but found the benefits monumental for our out-of-state patients seeking an opinion or a continued connection with their treating physician. We envisioned this silver lining of the horrific COVID-19 crisis as the way of medicine in the future.” MacDonald Shannon in this #FutureOfTelehealth Digital Symposium piece, leverages on her experience treating patients during the COVID pandemic to highlight the life-changing benefits of lifting state licensure restrictions for telemedicine. #BillOfHealth Mass General Brigham The Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics at Harvard Law School Carmel Shachar Susannah Baruch https://lnkd.in/e6WnJJ6A

“Telemedicine has the potential to transcend geographic and economic barriers, offering patients access to the best medical experts, regardless of location. This is especially crucial for participants with rare or life-threatening conditions who want to enroll in clinical trials.” In this #FutureOfTelehealth Digital Symposium piece, Helen Hughes MD, MPH and Mark Sulkowski, MD of Johns Hopkins Medicine explore the need to advance access to health care through federal medical licensure reciprocity for clinical trials. #BillOfHealth Read: https://lnkd.in/eHRGig6b Carmel Shachar Susannah Baruch The Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics at Harvard Law School Arizona Telemedicine Program University of Arizona, James E. “Overall, when it comes to delivering care via telehealth, state policies often create roadblocks to accessing care by prohibiting asynchronous care or limiting reimbursement to video-only visits. Unfortunately, legislators and medical boards similarly fail to consider patient preference and clinical indication when it comes to allowing access to telehealth services.” In this article for “The Future of Telehealth Regulation” digital symposium, Dana Northcraft and Natalie Birnbaum of RHITES (Reproductive Health Initiative for Telehealth Equity & Solutions) analyze the equity implications of telehealth policy on medication abortion care service delivery. #BillOfHealth #FutureOfTelehealth Read: https://lnkd.in/eNtdqDnB The Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics at Harvard Law School Mass General Brigham Johns Hopkins Medicine Arizona Telemedicine Program Carmel Shachar Susannah Baruch

Read the introductory piece of the ongoing Bill of Health symposium, "The Future of Telehealth Regulation."
"Part of what makes telehealth an exciting new modality for delivering care is that it is geographically unconstrained. This proved to be an important feature during the pandemic, when connecting patients to physicians across the country during a time of health care shortages was challenging. Telehealth’s divorce from geography remains important, especially for patients who struggle to find appropriate providers within their local communities." In the opening article for the digital symposium “The Future of Telehealth Regulation” Carmel Shachar, Faculty Director of the Health Law and Policy Clinic at Harvard Law School Center for Health Law and Policy Innovation and Symposium Editor, speaks to potential licensure reforms for cross-state telehealth. #BillOfHealth #FutureOfTelehealth Read Carmel's piece: https://lnkd.in/eAB9XZVS The Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics at Harvard Law School Arizona Telemedicine Program Johns Hopkins Medicine Mass General Brigham
