Congratulations to Brett Lean on his summary judgment win in Bronx County before Justice Gerez! Plaintiff’s claim involved allegations of a failure to timely diagnose and treat an aortic dissection resulting in the death of the patient. A 64-year-old man went to a hospital with complaints of abdominal pain and difficulty breathing. His complaints began three days prior, and he was seen at two prior hospitals before coming to this hospital. The patient arrived at the emergency department in mild-moderate distress. He was observed in the emergency department and underwent imaging tests. However, after the tests began, the patient's condition rapidly worsened. He became pale, sweaty, and struggled to breathe before losing consciousness. Despite immediate life-saving measures, the man could not be revived. After careful review of the case, the Court granted Brett’s motion for summary judgment on behalf of two doctors and the hospital. #LegalVictory #DefenseVerdict #MedMalCase #HealthcareDefense #DefenseTrialLawyers

Shaub, Ahmuty, Citrin & Spratt, LLP is pleased to announce that Robert Castillo has secured a defense verdict in a Westchester County ER negligence case. The plaintiff alleged that she was improperly and forcibly removed from the emergency room by the security staff causing a rotator cuff tear and superior labral tear in her shoulder. She presented to the ER with complaints of back pain, was given pain medications, and cleared for discharge but refused to leave, alleging that she felt unsafe to drive. The hospital appropriately provided plaintiff an opportunity to wait in the waiting area, but she continued to be aggressive and disruptive, which then required a call to police to have them escort plaintiff off the premises. At trial, Rob successfully demonstrated that the security staff acted properly as they did not use any physical force on plaintiff. Furthermore, it was proven that plaintiff’s injuries were as a result of wear and tear rather than trauma, which is consistent with the fact that defendant did not use any physical force to remove plaintiff from the hospital. After a short deliberation, the jury found a unanimous verdict in favor of the defendant. Rob was assisted by associate Michael J. Shaub, Ahmuty, Citrin & Spratt, LLP attorney Michele McEnroe has achieved a significant win by securing the dismissal of all medical malpractice claims in a case involving allegations of delayed brain cancer diagnosis. Michele successfully argued that all interactions between the decedent and defendants occurred well beyond the statute of limitations, even with consideration of Covid-tolling. She further contended that Laverne’s Law was inapplicable as subsequent medical records did not confirm a cancer diagnosis. In addition, Michele challenged the plaintiff’s claim for negligent infliction of emotional distress, citing its non-recognition under New York law. The Court granted the motion in its entirety, dismissing all medical malpractice claims and the claim for emotional distress, thereby eliminating all claims that could support an award of damages for pain and suffering. #LegalVictory #DefenseVerdict #MedMalCase #HealthcareDefense #DefenseTrialLawyer
