Selendy Gay and Delaware co-counsel Ross Aronstam & Moritz secured a very significant trial victory on behalf of the former stockholders of Auris Health, Inc. (represented by Fortis Advisors) in their long-running earnout dispute with Johnson & Johnson. Following a January trial, the Delaware Court of Chancery issued a decision awarding more than $1 billion in damages for J&J’s breach of contract, breach of implied covenant, and fraud. The decision constitutes the most important precedent and largest award in Delaware history in an earnout case. BIG NEWS! The United States District Court of Middle Tennessee ruled in favor of our clients in the AMC v. Smith case against TennCare. This victory comes after years of hard-fought litigation, proving TennCare violated their rights under the Medicaid Act, the Fourteenth Amendment's Due Process Clause, and the ADA. Selendy Gay’s pro bono team obtained an important victory on behalf of a transgender woman who was persecuted in her home country for her gender identity and sexual orientation. Based on the strength of the briefing and supporting evidence that the Selendy team submitted—an over 2,500-page submission—the Department of Homeland Security chose not to oppose our client’s application for asylum, and the judge granted asylum from the bench without requiring a hearing on the merits.
