David R. Kinzer, Associate, Troy, has authored a Construction Industry Newsline article, “Cross Currents at the Supreme Court, as Justices Split Over Worksite, Power Line Injury.” > https://bit.ly/3Yg49Vs On July 18, 2024, the Michigan Supreme Court announced another of the term’s major cases, El-Jamaly v Kirco Manix Construction, LLC, __ Mich __; __ NW3d __ (2024) (Docket No. 164902–164904), this one concerning construction liability. Unlike other recent decisions, El-Jamaly declined to explicitly overrule past precedent or increase businesses’ duty to employees or contractors. Nevertheless, the case provides plaintiffs’ bar with sharper tools to defeat motions for summary disposition and force more cases to trial. Associate Dayne J. Rogers, Troy, has authored a Property Owners & Insurers Newsline article, “Who’s in Control? The Clear Line Between Ordinary Negligence and Premises Liability.” Read Mr. Rogers’ article here > https://bit.ly/4cOqgH2 Farrar v Misch contrasts the differences between ordinary negligence and premises liability claims. Where a plaintiff’s injuries resulted from a person’s actions or inactions, a claim for ordinary negligence may be viable. However, where a plaintiff’s injuries resulted from a dangerous condition on the land, an individual may be liable under a theory of premises liability if the individual possessed and exercised control over the land. Partner Matthew T. Nicols, Troy, has authored a Property Owners & Insurers Newsline article, “Michigan Supreme Court Opens the Door to Common-Law Premises Liability Claims Against Condominium Associations.” Read Mr. Nicols’ article here > https://bit.ly/3W0cnxZ The Michigan Supreme Court ruled that co-owners of condominium associations are no longer limited to breach of contract and injunctive relief lawsuits against their associations. Now, co‑owners may sue their associations in common-law premises liability claims which, for the last decade, were not viable because by the nature of one’s ownership interest in a condo unit they were a co-owner and thus could not sue themselves. The Supreme Court gives co-owners an “Invitee” status, who are owed the highest duty owed by land possessors, and has allowed a common-law premises liability claim to proceed against the association. Mr. Nicols is a member of the Firm's Appellate, Insurance Coverage, Motor Vehicle Litigation, and Premises Liability Practice Groups; for info re Mr. Nicols > https://bit.ly/3Z9NIZf ; 248-539-2834 or [email protected]; to sign up to receive Secrest Wardle newsletters> https://bit.ly/3PtRmKg
