United States, which permits prosecutors to introduce expert testimony about the mental states of people "like" the defendant, and identify practical strategies for defense counsel to limit the impact of such testimony and—even better—use Diaz to defendants’ advantage. Quinn Emanuel Associate Anne-Raphaelle Aubry and Partners Tigran Guledjian and Eric Huang have authored an article published in the August edition of German patent publication GRUR Patent, titled “Anti-Suit Injunctions in the United States in the SEP and FRAND Context: Recent Developments and Overview”. The article looks at factors U.S. courts consider to determine the propriety of an ASI, and discusses specific cases involving ASIs and SEPs, including the February 2024 Ericsson v. Lenovo decision (E.D.N.C.).
