BIS has published a Final Rule in today's Federal Register adding 123 entities under 131 entries to the Entity List. A wide range of destinations are captured including Canada, China, the Crimea Region of Ukraine, Cyprus, Iran, Kazakhstan, Kyrgyzstan, Russia, Turkey, Ukraine and the UAE. All of the entities have been added based on a determination that they are acting contrary to the national security or foreign policy interests of the United States. Be certain that any screening tool being used has been updated to reflect this modification.

A great start to a full day of meetings in D.C. on behalf of the National Association of Foreign-Trade Zones (NAFTZ)! Kicking it off was a meeting with Troy Miller, the Senior Official Performing the Duties of the Commissioner for U.S. Customs and Border Protection, during which the NAFTZ Executive Committee and members of its Staff discussed the positive working relationship NAFTZ has with CBP and continued efforts to work collaboratively in support of the trade. Shannon Fura, as Chair of the NAFTZ Board of Directors, led the charge along with Katie Tangman and Eric Berry, fellow Members on NAFTZ's EC, and Jeffrey J. Hot off the presses! BIS has released a new guidance document on actions it takes to inform both industry and academia about parties outside of those already specified on public screening lists that present risks of diversion of items subject to BIS export controls to countries or entities of concern. The guidance also outlines certain responsibilities companies and universities have to comply with BIS regulations, as well as additional steps they should take to mitigate diversion risks. Finally, it includes a new recommended "red flag" best practice asking that exporters, re-exporters and transferors of Common High Priority List (CHPL) items screen transaction parties using online resources made newly available by the Trade Integrity Project (TIP) which identifies third-country suppliers with a history of exporting CHPL items to Russia since its full-scale invasion of Ukraine. #diversion #reexports #exportcontrols #Russiasanctions #Russia #wheretradematters #tradecompliance #duediligence #exportsanctions #sanctions
