In recent years, you’ve probably noticed an uptick in ads from law firms promising big settlements or a quick resolution to your legal troubles. These ads often present themselves as public health alerts, warning viewers that the use of a consumer product can cause illness or disease, even if such claims are contrary to scientific consensus. Trial lawyers are spending heavily on TV and digital ads to recruit clients and influence juries, often misleading consumers about product safety and promising large settlements. Third party litigation funding is a growing problem in the U.S. The industry operates with little oversight, and no one involved in a lawsuit knows if outsiders are secretly funding and controlling the litigation. Rep. Darrell Issa (R-CA) recently released a discussion draft of the "Litigation Transparency Act of 2024," which would require funding agreements to be disclosed and produced in all federal civil litigation.
