    How to Challenge Government Overreach in H1B Visa Cases Facing legal challenges from the U.S. government over visa petitions can be daunting, especially when the government introduces terms and requirements that aren't supported by law. The key legal question often revolves around whether the job in question qualifies as a "specialty occupation" as defined by immigration law. It's crucial to argue that the focus should be on the occupation itself, not on specific projects or job positions. The government's inquiry should be limited to determining if the job is within a specific geographical area, which is relevant for setting the prevailing wage. There’s no statutory requirement for a "position articulation" or a detailed job description. Position vs. Occupation: The government may use terms like "position articulation" to muddy the waters. It’s important to clarify that a specialty occupation can encompass multiple positions or even none, as long as the person is qualified and paid according to the law. Non-Productive Status: Highlight that under immigration law, an employee can be in non-productive status (e.g., due to lack of work) and still be in compliance, as long as they are being paid. This nullifies the government’s argument that a specific job or project must be identified at all times. End-Client Confusion: The government might try to distinguish between types of employers using terms like "end-client." However, all employers are treated equally under the law. The focus should remain on whether the employer is paying the employee and whether the employee is qualified for a specialty occupation. Emphasize that the government’s role is strictly limited by statute. Any expansion of these requirements by USCIS, such as demanding detailed job positions or specific projects, is an overreach not authorized by Congress. Be aware of the political leanings of the judges. Conservative judges may be more receptive to arguments about government overreach and administrative overreach, while liberal judges might focus more on unconstitutional expansions of government authority. Even if the initial ruling is unfavorable, all is not lost. Cases often return to the original judge, who may still dismiss the charges if the government cannot prove material fraud. By focusing on these core principles, you can effectively challenge government overreach in visa cases and ensure that the law is applied fairly and correctly.
