Hecker Fink LLP and the Howard University School of Law Civil Rights Clinic filed an amicus brief in the Seventh Circuit Court of Appeals on behalf of a group of federal courts scholars in support of the Plaintiffs-Appellants in 𝐴.𝐵., 𝑏𝑦 𝑁𝑒𝑥𝑡 𝐹𝑟𝑖𝑒𝑛𝑑 𝐵𝑟𝑖𝑎𝑛 𝑊𝑖𝑙𝑠𝑜𝑛, 𝑒𝑡 𝑎𝑙. 𝑣. 𝐸𝑟𝑖𝑐 𝐻𝑜𝑙𝑐𝑜𝑚𝑏, 𝑒𝑡 𝑎𝑙. The brief argues that the Northern District of Indiana District Court erred in its holding that the 𝑌𝑜𝑢𝑛𝑔𝑒𝑟 doctrine precluded it from exercising jurisdiction in the at-issue child welfare proceeding, based on the Seventh Circuit’s decision in 𝐴𝑠ℎ𝑙𝑒𝑦 𝑊. 𝑣. Hecker Fink LLP Partner John Quinn earned a “shout-out" in The American Lawyer’s “Litigator of the Week” column for securing a ruling on behalf of Portier LLC striking down a New York City law requiring delivery services to provide restaurants with certain customer's information, including full name, email address, phone number, delivery address, and order contents. Earlier this week, U.S. District Judge Analisa Torres granted DoorDash, Portier, and Grubhub's motion for summary judgement, finding that the law violated the First Amendment. Today, the New York Court of Appeals held that Robert F. Kennedy, Jr.'s appeal did not raise a substantial constitutional question and declined to exercise discretionary jurisdiction. That decision ends RFK's appeals in New York state court and confirms that he will not appear on the New York General Election ballot. Yesterday, Hecker Fink LLP and the State Democracy Research Initiative filed an amicus brief on behalf of a group of legal scholars in the Pennsylvania Supreme Court in Black Political Empowerment Project v. Schmidt. The brief urges the Court to affirm the decision below, concluding enforcement of Pennsylvania’s mail-in ballot dating provisions violates the Pennsylvania Constitution’s guarantee of free and equal elections. The brief supports Petitioners’ arguments that the ballot dating provisions, which require voters to date the outer envelope containing a mail-in ballot, serve no function in election administration and cannot withstand constitutional scrutiny. Amici argue that the Pennsylvania Supreme Court has long held that hurdles to electoral participation that serve no meaningful purpose violate the Pennsylvania Constitution’s textual and structural commitment to democracy. Enjoining the ballot dating provisions—which are irrelevant to a ballot’s timeliness but risk disenfranchising tens of thousands of voters—fits comfortably within the Court’s longstanding precedent.
