On August 20th, a Texas federal court struck down the FTC's Final Rule prohibiting non-compete clauses, deeming the rule "arbitrary and capricious" and beyond the agency's authority. The ruling, which follows a temporary injunction, sets aside the nationwide ban and highlights the court's criticism of the FTC's broad regulatory approach.
