This week, two Gibson Dunn teams earned shout-outs from The AmLaw Litigation Daily's Litigator of the Week.   A team led by partners Harris Mufson (New York) and Ilissa Samplin (Los Angeles) was lauded for knocking out a good chunk of the trade secrets and poaching case brought by First-Citizens Bank and Trust Co. against their client HSBC. The team included partners Lee Crain (New York) and Elizabeth Papez (Washington, D.C.) as well as New York associates Doran Satanove and Vanessa Ajagu and San Francisco associate Susanna Griffith Schuemann.   Another Gibson Dunn team, led by partners Cyrus Benson (London) and Rahim Moloo (New York), was recognized for winning $154 million in damages plus interest and more than $4 million in legal fees for client Corral Morocco Holdings in an arbitration against the Kingdom of Morocco. That team included partner Charline Yim (New York), of counsel Ceyda Knoebel (London), and associate Nadia W. (London).   Read more here: https://lnkd.in/emvcKNK4   #Litigation #Arbitration

Washington, D.C. partner Ryan Stewart discusses some of his most challenging cases in an interview with Law360. With few rulings favoring employers in cases invoking violations of the Illinois Biometric Information Privacy Act, he recently convinced nine plaintiffs to drop their $160 million in claims against car rental company Enterprise. “I try to focus on … being very proactive and going out and trying to move things forward and vigorously representing our clients.” Ryan also talks about Gibson Dunn’s free market system and how it allowed him, as a young lawyer, to find work that spoke to him. “I'm motivated to tell a compelling story. I love the facts. That's why I'm an employment attorney.” Ryan was recently recognized by Law360 as a 2024 Employment Rising Star. #Employment

A Gibson Dunn pro bono team has filed an amicus brief in the U.S. Supreme Court on behalf of 42 former Immigration Judges and members of the Board of Immigration Appeals in support of the petitioner in Bouarfa v. Mayorkas. The case concerns the availability of judicial review under 8 U.S.C. § 1252(a)(2)(B)(ii), a provision of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA), which eliminates judicial review of certain decisions in immigration proceedings that are committed to the discretion of the Attorney General or the Secretary of Homeland Security.    Most circuit courts have interpreted this text to preclude judicial review of executive branch discretionary decisions, but the Eleventh Circuit’s recent decision in Amina Bouarfa’s case bars judicial review of nondiscretionary, predicate determinations. Because the subsequent reassessment of Ms. Bouarfa’s spousal visa was classified as a revocation rather than an initial denial, the Eleventh Circuit concluded that the IIRIRA barred judicial review. The firm’s amicus brief seeks reversal of the Eleventh Circuit’s decision and asks the Court to resolve the current circuit split in favor of holding that the statutory bar to the review of discretionary decisions does not extend to underlying nondiscretionary determinations like the one at issue here. Our New York pro bono team was led by partner Richard Mark and included partner Amer Ahmed and associates Vanessa Ajagu, Sasha Dudding, and Michael Blank.   Since 2018, Gibson Dunn has represented this group of former Board of Immigration Appeals members and Immigration Judges pro bono in more than a dozen amicus filings on significant issues of immigration law. #SCOTUS #IIRIRA #Immigration #AG #HomelandSecurity
