Director Doris Bobadilla and Special Counsel Frances McGinnis successfully secured summary dismissal of claims for insurance coverage in a commercial construction litigation case. In this case, the Plaintiff, the owner of the building, alleged defects in a new roof structure and roofing over a commercial building and filed suit against the Named Insured and the Insurer under Louisiana's Direct Action Statute. Doris and Frances moved for summary dismissal powered by the argument that the commercial general liability policy clearly and unambiguously excluded coverage pursuant to exclusions in the policy. Our team argued that it is well established in Louisiana that courts look to factual, not conclusory, allegations of the petition to determine whether the Insurer must defend the insured. The Court held that the insurance policy excluded coverage for the claims brought by the Plaintiff. Since April, Galloway employment lawyers Doris Bobadilla and Wendell Hall have stayed up-to-date with the latest involving the Federal Trade Commission ruling that sought to ban most #noncompete agreements. Here's the latest on this ongoing situation: On Tuesday, a federal district judge in Texas permanently blocked the #FTC final rule on noncompete agreements on the grounds that the regulation exceeded the agency's authority. An FTC spokesperson indicated that the agency is considering an appeal.
