Fix PAGA: There's A Better, Fairer Way for Workers
Political Organizations
It’s long past time for the Legislature to fix PAGA to create a better, fairer system for workers.
About us
Enacted in 2004, California’s Private Attorneys General Act (PAGA) was intended to be a more effective way to help workers resolve labor disputes. Two decades later, it’s clear that PAGA’s lawsuit-first approach has failed – it’s ineffective and inefficient for workers and unfair for thousands of small businesses. California has an existing, capable administrative process and agency – the Labor and Workforce Development Agency (LWDA) – that has a proven record of resolving claims faster with money going directly into workers’ pockets.

Fix PAGA: There's A Better, Fairer Way for Workers reposted this
The Sacramento Metro Chamber has been in strong support of the Fix PAGA efforts in partnership with @CalChamber. As of this week, executive leadership of the measure has worked with the Governor’s office and Labor to come to a deal for meaningful PAGA reform. That deal is now in print in Senate Bill 92 (SB 92 - Umberg) and Assembly Bill 2288 (AB 2288 -Kalra) and will be voted on this week in both houses in order to be passed by the legislature and signed by the Governor in time for the Thursday, June 27 deadline to remove the ballot initiative from the November ballot. This is crunch time and we need everyone’s support to get this across the finish line and tell the legislature to Fix PAGA! See link here for details: https://lnkd.in/gfu2TWET These PAGA reforms are the biggest reforms of the last few decades and will give employers time to correct violations and reduce the shakedown lawsuits that have been plaguing businesses across the state.

While CA is sitting on hundreds of millions of dollars that could be used to address and resolve labor claims, PAGA’s lawsuit-first system is enriching attorneys at the expense of workers. #CALeg should create a better, fairer system and empower state enforcement. BREAKING: After months of discussions, our coalition is announcing its support for legislation that will fix CA’s Private Attorneys General Act. The agreement and legislation was announced today by Office of California Governor Gavin Newsom, Senate President pro Tempore and Speaker Robert Rivas. If passed by #CALeg, the measure would reform PAGA to ensure workers retain a strong tool to resolve labor claims and receive fair compensation, while limiting the shakedown lawsuits that hurt employers and employees. #FixPAGA https://bit.ly/4c3xfvi

Non-profits and small businesses have become targets of predatory PAGA lawsuits, often over minor technical violations. In a 2019 case, lawyers are asking for 40% of the settlement, while workers will get less than a percent. We need to #FixPAGA so non-profits can continue to provide vital services.

While lawyers are making millions, workers pay the price. After 7 years of litigation, a $27 million settlement was reached for a PAGA lawsuit. The plaintiffs’ lawyers walked away with $9 MILLION, while actual workers only received $20 each. #FixPAGA

The Labor Workforce and Development Agency is currently sitting on hundreds of millions of dollars. #CALeg should empower the agency to use untapped funds to resolve and address labor claims instead of the lawsuit-first PAGA system. CalMatters https://bit.ly/3z7dmVi

PAGA’s lawsuit-first approach to settling labor disputes is ineffective and inefficient for workers. It’s time to create a better, fairer system by utilizing the existing LWDA process to streamline resolution and help ensure swift and fair recovery for workers. Learn More > bit.ly/4bOrXU1
