🎉 Victory in Arbitration! 🎉 Our team at Doyle & Seelbach is thrilled to announce a significant win for our client in an employment dispute arbitration involving serious allegations of discrimination, retaliation, and wrongful termination. In this case, the claimant brought claims under the Family Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), and Title VII, alleging workplace harassment, retaliatory actions, and unlawful termination. The claimant, a long-term employee, argued they were subjected to adverse treatment following complaints of inappropriate behavior by a supervisor, which allegedly led to a performance improvement plan, demotion, and eventual termination. After a rigorous arbitration hearing, where our team presented extensive evidence and cross-examined witnesses, the arbitrator ruled in favor of our client, dismissing all claims. This outcome affirms the importance of defending against baseless allegations while ensuring fairness in the workplace. A special shoutout to Trek Doyle (Partner), Lydia C. Tsao (Associate), and William Templeton (Paralegal), whose tireless efforts and keen attention to detail were instrumental in this victory. Their hard work ensured our client’s interests were vigorously protected. We’re incredibly proud of this result and the dedication it took to achieve justice for our client. #ArbitrationSuccess #EmploymentLaw #DisputeResolution #Teamwork #DoyleSeelbach #ClientVictory #Litigation Doyle & Seelbach PLLC #Litigation #Arbitration

📱 New Legal Developments on Cell Phone Data in Litigation 📱 The Texas Supreme Court and appellate courts have been busy refining the rules around accessing cell phone data in litigation. Recent rulings emphasize that: 1️⃣ To obtain cell phone data, the requesting party must first present evidence suggesting that phone use may have contributed to the incident in question. 2️⃣ Any data produced must be limited to the timeframe where cell phone use could be relevant to the case. No fishing expeditions! 🎣 3️⃣ Personal privacy is key! Courts are ensuring strict safeguards to protect sensitive data during discovery. 🔒 Check out this detailed article breaking down the latest rulings, drafted by Andrew Schumacher and Cassandra Diaz of Doyle & Seelbach PLLC. 🎉 Another Win for our Legal Team! 🎉 Excited to share that Attorneys Josh Bolduc [https://buff.ly/3x64PkZ] and Jake Jones [https://lnkd.in/gTA-7zpE a significant victory for one of our nonsubscriber employer clients in a recent case. Our client, a leading grocery store chain, obtained summary judgment in a lawsuit brought by a former employee. The plaintiff alleged injury from tripping on a pallet of produce, claiming it was an unreasonably dangerous condition that our client should have warned about or removed. However, our team effectively argued otherwise: 1️⃣ The pallet wasn't unreasonably dangerous. 2️⃣ It was an open and obvious condition, not requiring a warning. 3️⃣ Plaintiff had actual notice of the pallet's presence, passing it daily in the same location. The court sided with our arguments, granting the motion for summary judgment and dismissing the case entirely! This win highlights our commitment to delivering robust defense strategies for our clients. #InjuryDefense #Litigation #Victory #PersonalInjury #PremisesLiability #Litigators

🎉 Another Success Story from Our Legal Team! 🎉 Exciting news: Attorneys Jake Jones and Josh Bolduc secured summary judgment in arbitration! Our client, a reputable grocery store chain, faced a lawsuit from a former employee who alleged an injury from slipping on a small drop of liquid on the floor. The plaintiff argued that the liquid constituted an unreasonably dangerous condition, placing blame on our client for not warning or removing it. However, our legal team presented a compelling case: 1️⃣ Our client had no prior notice of the dairy spill. 2️⃣ The size and inconspicuousness of the spill made it hard to detect. 3️⃣ Plaintiff's speculation about an employee causing the spill lacked evidence, considering the spill occurred in a public grocery aisle. The arbitrator sided with our arguments, granting our motion and dismissing the case entirely! This victory underscores our commitment to defending our clients with strong legal strategies. #LegalVictory #SummaryJudgment #ArbitrationSuccess #NonsubscriberEmployer #ClientSuccess #LegalExcellence
