Over the summer, DWT hosted our fourth annual Pre-Law Diversity Fellowship Virtual Academy! Fellows participated in two half-day seminars lead by DWT attorneys, departmental administrators, summer associates, and law school admissions staff, discussing their varied career paths, law school admissions and best practices for law school success. The Pre-Law Diversity Fellowship seeks to strengthen the pipeline of talent interested in pursuing careers in the legal profession by providing guidance and support to current college students. Fellows are paired with experienced mentors, attend quarterly cohort meetings, and participate in the virtual academy. The program is designed to cultivate their excitement for the legal field and help them strive for success. This year’s cohort is co-sponsored by Amazon, Expedia Group, Microsoft, and T-Mobile. Applications for the 2025 cohort will be accepted between October 7th and November 15th!

In a major victory for publishers and authors, the U.S. Court of Appeals for the Second Circuit has upheld a lower court decision finding the Internet Archive (IA) infringed the copyright in millions of books by scanning them without permission, posting the ebooks online, and then lending them to one user at a time as part of a "Free Digital Library." Affirming a district court opinion that granted summary judgment to four leading book publishing companies, the appellate panel ruled unanimously and unequivocally that IA's unlicensed mass-digitization enterprise is not "fair use." A DWT litigation team led by Elizabeth McNamara and Linda Steinman, and including Jack Browning, Jesse Feitel, and Carl Mazurek, represented the publishers at the district court and on appeal.

In a huge victory for authors and publishers, the 2nd Circuit today upheld a decision in favor of our clients Hachette Book Group, HarperCollins Publishers, John Wiley & Sons, and Penguin Random House, finding Internet Archive (IA) liable for copyright infringement. The appellate court rejected IA’s argument that “controlled digital lending” is defensible and found that its large-scale copying and distribution of copyrighted books, without permission from or payment to the publishers or authors, was not "fair use." As the court emphasized, IA "deprives creators of compensation and diminishes the incentive to produce new works." Congratulations to our clients and to the DWT team of Elizabeth McNamara, Linda Steinman, Jack Browning, Jesse Feitel, and Carl Mazurek on this important and hard-fought victory.
