Yesterday, Massachusetts voters rejected ballot Question 5, which would have gradually phased out the service rate for tipped employees. This means that Massachusetts employers of tipped employees do not need to re-calculate how those employees are being paid. But since the issue is likely at the top of mind, this is a great opportunity for employers to double-check how they were handling those calculations to begin with. There are some key pitfalls employers need to be worried about when ensuring they are properly compensating tipped employees, and we’ve written an overview describing some of these pitfalls.
