    Concerns about how robustly European member states may enforce the EU AI Act, which took effect on Aug. 1, are divided between if regulators will take a “light touch” approach or a sledgehammer for noncompliance. One thing’s for sure, the pace of AI innovation will make enforcement very difficult. Europe may be at the forefront of putting rules in place to prevent AI from causing harm to consumers, but it does not necessarily follow that regulators will have much appetite or capacity to enforce these rules or that companies know how to comply with them. Part of the problem is that the act leaves it up to individual countries to decide whether they want to set up their own dedicated AI regulator to oversee use, or whether they want an existing authority–namely, data protection authorities (DPAs)–to add AI monitoring to their remit. Critics have pointed out that many DPAs are already bowing under the pressure of dealing with a growing number of complaints relating to the General Data Protection Regulation. Lengthy investigations, coupled with cumbersome procedures (particularly in cross-border cases), has put a strain on many DPAs’ budgets, leading to wide variances in enforcement approach across the EU bloc. The idea that data regulators will now also need to hold companies to account for AI misuse and abuse makes it difficult to see how they might enforce the AI Act effectively.     The proliferation of artificial intelligence–as well as the promised business cases promoting its use–has led companies around the world to quickly invest in the technology. Companies say they’re testing and deploying systems ranging from off-the-shelf chatbots to bespoke databases and writing aids. Executives hope these AI tools will improve efficiencies, reduce costs, and help them stay competitive. But it could lead to just the opposite. Industry watchers say that as a broader range of companies buy in, an increasing number of organizations are unaware whether the AI technologies they have deployed are legally safe; where the data these systems are trained on has come from; or whether they as users–and not necessarily the firms that have developed the technology–may find themselves in the firing line with regulators for any incidence of noncompliance. Added to that, companies lack awareness that AI misuse can result in penalties from several different regulators at the same time–and not just in one jurisdiction. “The legal landscape is constantly evolving,” said Jason Raeburn, intellectual property and technology litigation partner at law firm Paul Hastings. And the potential legal threats appear to be as varied as the different AI applications companies are creating. “It is crucial that compliance is a top priority for businesses looking to avoid multi-jurisdictional investigations, litigation, and severe sanctions,” he added. Many of the questions raised by the risks of AI will be a central theme of discussions at Compliance Week’s AI & Compliance Summit, which is being held Oct. 8-9 at Boston University, and Compliance Week Europe, Oct. 15-16, in Amsterdam. The event will gather business leaders, academics, and government officials to discuss some of the biggest questions around AI, including business adoption standards, ethical guardrails, and its application in decision making.
