West Palm Beach Partners John Chiocca and Kristina Correa and West Palm Beach Associate Nicholas Cardamone recently obtained a great result in Palm Beach County after a three-day jury trial on a breach of contract/indemnity claim. The client, a stucco contractor, entered into a subcontract agreement with a general contractor for a $2M+ project. Following completion of construction, the owner brought defect claims against the GC who in turn sued fourteen subcontractors, including the client. After five years of litigation, all parties except the client settled their respective defect claims. The GC then assigned its claims against the client to the owner to pursue indemnity claims against the client. The Friday before the Monday trial, the court ruled that the defense could not argue a lack of liability for the alleged defects, thereby precluding testimony from the defense's expert witnesses. At trial, Plaintiff asked the jury to award nearly $800,000 in attorneys' fees and costs that were incurred by the GC in defending the defect claims. After several hours of deliberation, the jury awarded just $55,000 in damages to Plaintiffs, or roughly 8% of what was claimed. I am a South Florida native, growing up in Coral Springs. I dabbled in college baseball for two years prior to attending Florida Atlantic University to acquire my Bachelors degree in Political Science. Orlando Partner Stephanie McCoy and Miami Associate Katrina Fernandez, Esq. recently secured summary judgment in a slip and fall case in Palm Beach County. The Plaintiff slipped on a clear liquid substance in the main aisle of our client's store. As a result of the incident, Plaintiff was claiming injuries to her neck, shoulder, and back with over $200,000 in past medical expenses.. Plaintiff argued our client was on constructive notice of the liquid on the floor because an employee walked through the incident area approximately 40 seconds before Plaintiff's incident. However, Plaintiff testified the liquid was clear without footprints, track marks or dirt. Plaintiff also testified she did not know where the liquid came from or how long it was on the floor before she slipped and fell. Ms. Fernandez successfully argued that Plaintiff was unable to establish her claim of negligence without impermissibly stacking inferences. Miami Partner Sarah Egan recently obtained a summary judgment in a premises liability case in Broward County against a well-known Plaintiff firm. The Plaintiff slipped and fell as he attempted to enter our client's restaurant, which was seen on the store surveillance footage. As a result, Plaintiff underwent several procedures to his back and accumulated medical bills of around $150,000. The Court granted our client's Motion for Summary Judgment finding Plaintiff failed to prove a dangerous condition existed that caused him to fall. We served a Proposal for Settlement on behalf of our client and will be entitled to recover our costs and fees. Orlando Partner Chris Wasula and Associate Rebecca Burton recently argued and persuaded the court to grant a motion for summary judgment in a hotly contested "failure to hire" claim. Plaintiff claimed that her client was not hired as retaliation for the plaintiff's involvement as a witness to a claim brought by a co-worker. Despite Plaintiff's counsel passionate argument, and thanks to a lot of preparation, Chris successfully argued the plaintiff did not have sufficient evidence supporting the claim that the employer was aware of the activity when he rejected the application. This great result is especially significant as it will assist in the defense of several companion cases. CSK Of Counsel Paul Lester was recently featured in an article on Newswire.net about the impact of the Supreme Court's Decisions in the Loper and Relentelss Companion Cases. According to Lester, the Chevron Doctrine established the authority of experts in federal agencies, which operate under the President as part of the Executive Branch, to interpret legislation in their areas of specialization. Judges would defer to the expertise of these highly qualified individuals during court cases. The U.S. Supreme Court's recent decisions in the Loper and Relentless cases have ended this 40-year-old legal precedent.
