Catrina Markwalter has joined as a member of the firm's construction group while Michael Ross has joined as of counsel in its litigation group, the firm announced Tuesday. Markwalter is based in Florida while Ross is based in Atlanta. ... Markwalter guides clients on construction and secured loan litigation, the firm said. Markwalter represents commercial construction clients on development and general commercial disputes in state and federal court. She also counsels clients on loans from the U.S. Small Business Administration and the U.S Department of Agriculture. Further, she represents cybersecurity clients on contract matters. ... Markwalter said that before she joined, she spoke with former Taylor English partners who had moved to Clark Hill. "I was really impressed with its culture and the breadth of practice areas they have and, of course, their geographic coverage," Markwalter said. For Markwalter, the firm's larger platform will be helpful since she serves multiple clients as general counsel. "I like the fact that even though there are almost 800 attorneys, the firm seems to focus on being very collaborative, but at the same time trying to maintain efficiency and being able to effectively respond to your clients in a timely manner," Markwalter said. ... "I am very excited to help Clark Hill expand in the Southeast," she said. "I'll be the first person that's actually in Florida for Clark Hill, but I will be affiliated with their Atlanta office." Allison D. Castillo, director of the firm's business units for construction and litigation, said in a statement that she's glad that Markwalter has made the move to the firm. Castillo is based in the Los Angeles area, according to her LinkedIn profile. "Her experience with clients throughout the Southeast and East Coast will greatly bolster our group's reach and capabilities," Castillo said. The pair of new additions come after the firm opened its first Atlanta office earlier this year. Eight lawyers from Taylor English helped found in July the Georgia office, the firm's 29th office. Christina Moore, Mark Florak, Bob Goldberg, Allen W. Nelson, Ryan K. Owens, Kent Webb, Manori de Silva, and Steven Whitehead joined. Moore serves as member-in-charge for the Atlanta office. Seven of the attorneys join as members, while Whitehead joins as senior counsel.

"An ounce of prevention is worth a pound of cure." One of the most important sections of any construction contract is the Scope of Work, which outlines exactly what work will be performed. Unclear or ambiguous scopes are one of the leading causes of disputes in construction projects, sometimes leading to litigation. This is true in Michigan, where disputes over construction contracts are not uncommon. If you're a contractor or subcontractor, one way to protect yourself from disputes over scope creep or unexpected additional work is by including clear language in the contract that limits your responsibility to only the explicitly named work. On the other hand, an owner or general contractor will want language in its contracts that obligates the general or downstream contractor to complete work that is reasonably inferred or incidental to the contractor's scope. By striking the right balance, contractors can avoid unanticipated responsibilities and owners or upstream contractors can ensure the construction team completes the project in a manner consistent with expectations. To take this full circle, spending a fraction of the contract price up front for a construction lawyer to review and negotiate your contracts can go a long way to avoid much costlier controversies down the line because of vague or loose language. #constructionlaw #contractnegotiation #scopecreep Clark Hill Law

The second proposal relates to establishing a statewide tax court. Tyson stated that a yes vote would help alleviate pressure on superior courts by creating a specialized court to handle business and tax disputes. The final item on the ballot is a statewide referendum that seeks to increase the property tax exemption for tangible personal property from $7,500 to $20,000. This measure would provide businesses with more flexibility regarding taxes on essential equipment. Tyson acknowledges that the ballot language can be complex, urging voters to visit the Secretary of State's website for clarification before voting.
