Agencies carving out their own niches in regulating connected cars is the latest example of the broader ongoing fight for control over privacy and security regulations, said Matthew Baker, who leads the privacy and cybersecurity practice at Baker Botts. With agency power now under a microscope after Loper Bright, piecemeal regulations to emerging issues may become the standard way forward. “We’re already seeing it, right?” Matthew told Bloomberg Law. “With the FCC and the Department of Commerce leaning on their current statutory authority to enact rulemaking within their authority, and that’s why you’re going to see the patchwork that’s occurring around it.”

"Delaware case law has been established over a really long time. There’s a lot of precedent there. By and large, you know at least what the guiding principles are in the law. And you may have a good sense for how a case is going to come out. There’s certainly a pretty strong roadmap for a lot of cases that may be brought,” Baker Botts partner Samantha Crispin told the Texas Lawyer. Texas, in comparison, has a dearth of case law, Crispin said. “There isn’t that roadmap, so there is uncertainty as to how it’s going to go,” Crispin said. “We’ll see how the judges decide the cases. Their opinions need to be written, which will start to establish a baseline of precedent to look to, and for companies to get a feel for how the judges are going to come out on various issues.”

Baker, chair of the privacy and cybersecurity practice group at Baker Botts, told Law360. "It's easier for consumers to conceptualize when companies talk about what data they're collecting from them, but it's much harder for them to understand even what an algorithm is and the impact of companies using their #data to train these models."
