On August 14, the United States District Court for the District of Delaware vacated a $107.5 million jury verdict in Wyeth LLC v. AstraZeneca Pharmaceuticals LP and AstraZeneca AB, ruling the asserted patent claims invalid due to lack of enablement and lack of written description. The court found that the patents did not provide adequate guidance for safely administering the claimed pharmaceutical compounds, particularly when toxic dosages might be necessary for therapeutic effects. In an article for Bloomberg , AGG Food & Drug chair Alan Minsk discusses FDA’s revised draft guidance on how medical product manufacturers should respond to false or misleading information on social media.
