    This Privacy Policy applies to the processing of information about members and other individuals that we collect when you use our “Platform,” which means any website, application, or services we offer or when you communicate with us. We may also process your personal data to tailor the marketing content and certain services or website experiences to better match your interests on ClientWise LLC and other third-party websites.

    Our legal basis for collecting and using the information described above will depend on the type of information and the specific context in which we collect it.

    1. We process information about you in order to provide our services in accordance with our Terms of Use, for example, to allow you to join ClientWise LLC, or to display your profile to other ClientWise LLC participants in your service, and to allow us to send you important service updates.

We also process information about you where it is in our legitimate interests to do so and not overridden by your rights (for example, in some cases for direct marketing, fraud prevention, network and information systems security, responding to your communications, the operation of networks of groups by the network administrators, and improving our Platform).

This includes other users you are sending or receiving funds from, and merchants and their service providers.
    • With other third parties for our business purposes or as permitted or required by law: We may share information about you with other parties for ClientWise LLC’s business purposes or as permitted or required by law.

    3.1 Through Your Participation In ClientWise LLC Services
    We share some of the information that we collect by displaying it on a Client Roster according to your profile and account settings.

    Some information, such as name, company, and contact information, will be visible to other members of ClientWise LLC. We find it helpful to have access to the email addresses of organizers and other members of groups within their workshop series to easily communicate with. Therefore, we ask that if you do not want to share your contact information your group, please contact [email protected].

    3.2 With Our Service Providers
    We may use service providers in connection with operating and improving the Platform to assist with certain functions, such as payment processing, email transmission, conducting surveys or contests, data hosting, managing our ads, and some aspects of our technical and customer support. We take measures to ensure that these service providers access, process, and store information about you only for the purposes we authorize, subject to confidentiality obligations.

    3.3 Following The Law And Protecting ClientWise LLC
    We may access, preserve, and disclose information about you to third parties, including the content of messages, if we believe disclosure is in accordance with, or required by, applicable law, regulation, legal process, or audits. We may also disclose information about you if we believe that your actions are inconsistent with our Terms of Service or related guidelines and policies, or if necessary to protect the rights, property, or safety of, or prevent fraud or abuse of, ClientWise LLC or others.

    3.4 Affiliate Sharing And Merger, Sale, Or Other Asset Transfers
    If ClientWise LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of our assets, information about you may be shared, sold, or transferred as part of that transaction. We may also share information about you with current or future corporate parents, subsidiaries, or affiliates.

    3.5 Third Party Processing Payment Services. Payments processed via our Platform may be provided by a third-party payment processor and are subject to the terms of use and privacy policies of those payment gateways and are not accessible or controlled by ClientWise LLC. You hereby authorize the third-party agent to charge your credit card for the services, both in advance and on a periodic, renewal basis if applicable and in accordance with any terms and conditions of your application. Any third-party payment agent is not permitted to store, retain, or use your billing information except to process payment for the services you are registering for through ClientWise LLC.

    • This Privacy Policy is periodically updated and does not apply to third parties.

    4.1 Analytics And Advertising Services Provided By Others
    With your permission, we may allow others to use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the ClientWise LLC website and other websites and online services.

    4.2 Transferring of Information To Canada, The U.S., And Other Countries
    Given that the internet is a global environment, using the internet to collect and process personal data necessarily involves the transmission of data on an international basis. Personal information may be disclosed in response to inquiries or requests from government authorities in the United States or other countries in which we operate. Therefore, by browsing our website and communicating electronically with us, you acknowledge and agree to our processing of personal data in this way.

    ClientWise LLC is based in the United States. Information about you may be transferred to, and processed in, Canada, the U.S., and countries other than the country in which you are a resident. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective. We have taken appropriate safeguards to require that your information will remain protected in accordance with this Privacy Policy.

    4.3 Security
    We employ technical and organizational measures designed to appropriately protect your information that is under our control and that we process on your behalf from unauthorized access collection, use, disclosure, copying, modification, or disposal, both during transmission and once we receive it. We store all information that you provide to us on secure servers. We train employees regarding our data privacy policies and procedures, and permit authorized employees to access information on a need-to-know basis, as required for their role. We use firewalls designed to protect against intruders and test for network vulnerabilities. However, no method of transmission over the internet or method of electronic storage is completely secure.

    Where you have a password, which enables you to use our services, you are responsible for keeping this password complex, secure, and confidential. If you would like to update or change your password, you may select the “Forgot your password?” link on the login page. You will be sent an email that allows you to reset your password.

    4.4 Safeguarding Data
    ClientWise LLC takes all feasible and reasonable precautions to protect the personal information that we collect from you. Every staff member must sign a Proprietary Rights Agreement or other agreements wherein he/she agrees not to improperly use and/or improperly disclose any confidential personal information about clients or other individuals who have contacted ClientWise LLC. Also, your personal information is retained in a secure database, which is only accessible by password and is protected by the use of firewalls.

    4.5 Data Retention
    We retain certain information that we collect from you while you are a participant in ClientWise LLC services and on our website, and in certain cases where you have deleted your account, for the following reasons:

    • To ensure that we do not communicate with you if you have asked us not to;
    • To inform you about new products, services, and features offered by ClientWise LLC;
    • To determine if a new client has been referred by a former or current client;
    • To provide you with a refund, if entitled;
    • To provide accurate accounting information to you;
    • To better understand the traffic to our website so that we can provide all members with the best possible experience;
    • To detect and prevent abuse of our website, illegal activities, and breaches of our Terms of Service;
    • To comply with applicable legal, tax, or accounting requirements; and
    • To establish, exercise, and defend legal claims.

    When we have no ongoing legitimate business need to process your information, we will either delete or anonymize it. We retain personal information collected from you when you request information, register an account, apply for a workshop, and/or order a product online for a period of 15 years thereafter.

    This Privacy Policy does not apply to information that you provide to third parties, such as other participants enrolled in ClientWise LLC services. Our website may direct you to a third-party service, such as social media services, or a portion of our website may be controlled by a third party (typically through the use of a frame or pop-up window separate from other content on our Platform). Disclosure of information to these third parties is subject to the relevant third party’s privacy policy. We are not responsible for the third-party privacy policy or content, even if we link to those services from our website or if we share information with these third parties.

    4.7 Revisions To This Policy
    We may modify this Privacy Policy from time to time. When we do, we will provide notice to you by publishing the most current version on our Platform at www.clientwise.com/privacy and revising the date at the top of this page. If we make any material change to this policy, we will provide additional notice to you, such as by sending you an email or displaying a prominent notice on our Platform.

    4.8 Links To Other Websites
    Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over those other websites. Therefore, we cannot be responsible for the protection and privacy of any information that you provide while visiting such sites, and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

    4.9 How Do We Use And Store Personal Information You Provide To Us When You Request Information, Register An Account, And/Or Order Products Online?
    We will maintain your personal information in a secure database. We do not use the information in the database for any purposes other than facilitating your future orders, or to permit us to notify you of products, services, and features offered by ClientWise LLC. We do not store your credit card numbers or expiry dates in our database. Consequently, each time you choose to purchase an item, your name and shipping address will be pulled from the database, but you will have to re-enter your credit card information to complete the order.

    4.10 Our Policy Regarding Sharing and Accessing Your Personal Information
    ClientWise LLC does not sell, trade, or otherwise transfer the personal information you provide to us to third parties. We may allow authorized third-party service providers access to your personal information to perform services on our behalf. Our service providers are required to provide privacy protection comparable to ours and to limit their use of such information to providing services on our behalf. It may take up to ten days to process a request received by email or telephone, and six to eight weeks to process a request received by mail.     5.4 Some Information About The Use Of Cookies On Our Website
    Our website uses per-session cookies, which are commonly used tools to facilitate the exchange of information between your browser and our server. These cookies allow us to present, and you to view, certain graphic elements on the website.     • Your browser type, e.g., Netscape Navigator, Internet Explorer, etc.

    The information is collected by the server in an aggregate format so that we can assess those pages that are most frequented by visitors of our site. We do not link this information with the identity of any visitor to our website, to any of the information you voluntarily provide when you visit our site, or when you become a participant in the Program. Accordingly, ClientWise LLC will treat any information shared between your browser and our server as non-personal information.

    Your participation in ClientWise LLC services does not give you permission or grant you a right to solicit, directly or indirectly, on your own behalf or on behalf of any other person(s), any client of The ClientWise LLC Program, for the purpose of selling, marketing, or providing any product or service.

    5.6 Your Choices: Promotional Communications
    You can control messages that you receive from ClientWise LLC, other members, and third parties by selecting the unsubscribe link in the message that you receive, or by adjusting the communication preferences in your account settings. We will also send you a link to these settings when you first sign up and in subsequent messages. If you opt out, we may still send you non-promotional messages, such as those about your account or our ongoing business relations.

We do not use your personal data for any reasons not stated in this Privacy Policy and never use it in an excessive manner that is disproportionate to our aims of providing and improving our service or in a way that is contrary to your interests.

    How Long Do We Keep Your Personal Data? The personal data that you provide when registering using ClientWise LLC websites is retained until you ask us to delete it. If you wish to delete your account, you can do so by emailing [email protected]. Download histories are retained indefinitely. We also retain records of subscriptions and transactions for accounting purposes. Personal data contained within emails sent to us will be retained for as long as we reasonably require it. Questions relating to our content along with our answers to those questions may be retained unless you ask us not to in order to facilitate answering similar queries in the future, whether from you or from others. We also retain certain communications to aid in the conduct of potential future legal claims.
