I contracted with Andy Hromyak, with Natural Stoneworks, LLC, 10978 Richardson Road; Ashland, Virginia 23005, to install granite counter tops in my kitchen as well as a marble vanity top which was to be installed in the first floor bathroom of our new home. Our original agreement was that he would supply granite for my kitchen "Bianco Ramino" and a Carrerra Marble or a similar white marble with grey or black veins within the marble for our bathroom. An agreed upon price was set and the terms to our agreement were mutually satisfactory. This was in the first week in April. However, I did not receive the kitchen counter top that I had chosen and I might add "fallen in love with" because on the day that the granite was to be cut and installed, which was just days before our move, I received a phone call from Andy Hromyak stating that he had found flaws within the granite I had chosen and that the granite that he had been holding for my job for over a month also had a large crack in the stone, therefore making it not large enough for the kitchen installation. He asked that I come by his business location that day in order to show me the fissures and the "filled areas" of the granite that he had been holding for my job. After seeing the granite, he suggested not to use this granite because it was not of the quality that I had believed it was nor was it a product that he felt comfortable selling to me. He asked if I had time to choose another piece of granite so we went to his distributor to chose another slab of granite for my kitchen. I only saw ONE piece of granite that was even close to the color I had wanted for my kitchen and was told that I could go across town to several other of his distributors if I didn't accept the piece that I saw on that day. I was in the midst of a whole house renovation and moving the next weekend, so I did not have time to go across town to look at other granites. Our original agreement was that Natural Stoneworks, LLC would supply a white granite for my kitchen, "Bianco Ramino" and a Carrerra Marble or a similar marble for our downstairs bathroom. I told him on several occasions that we had installed black granite floor tiles in this downstairs bathroom and this was the reason that I must have the white marble. I have for years dreamed of a white granite for my kitchen countertops! Soon after our original meeting which was during the first week in April, Andy stated in a phone conversation that the marble that he currently had in stock that he originally wanted to use in our home would not be large enough for our bathroom. Therefore he instructed me to go to his supplier to chose several pieces of marble that I liked. (This occurred before he had seen the deficiencies in the granite.) I chose several marble pieces that I liked at his supplier's warehouse and he stated to me that he would obtain one of those that I chosen for our bath. Weeks went by, so I believed everything was on schedule as to our original agreement. However, everything changed just a few days before installation of the products was to occur and just days before we were to move into our new home. The week before our move, around midday on a Friday afternoon, Andy phoned me stating that the granite that I had believed was to be installed in my kitchen was unsuitable and that I would now need to chose another granite for the job. After seeing the granite per his request and my stating that I did not know if I would be able to accept it due to the flaws that he had "discovered", Andy suggested that he and I go to his supplier for a second time, this time to see if there was a new granite that would work with my kitchen color scheme. Needless to say, I was extremely disappointed not to mention also under a great deal of stress as I was moving within the week and had many things on my mind. I was in the midst of packing a house all by myself and the complete renovation of our new home. The ONLY granite that his supplier had in stock which would even come close to what I had originally wanted was a lighter tan, ""Millenium Creme". He said on that day that he would now not be able to obtain the marble for my downstairs vanity top because he now would have to purchase new granite for my kitchen because the one I originally chosen was flawed. He is the person who sold this granite to me and who held the inferior granite for my kitchen for weeks on his lot and yet I still tried very hard to work with him and to comply with this dilemma.However, I still told him over and over again that I desperately wanted white marble for our bathroom and that it was extremely important to me that I have a white product for our bathroom due to the color of the black tile just installed on the floor. He suggested that he make the vanity top out of the same granite which was to go into the kitchen and that was all he could do for me unless he added to the cost of our original price. I had a limited budget for the granite countertops and for the marble vanity top and was completely honest with Andy about this from day one. I stated that I had no additional monies for this installation and he made me feel that I had no choice but to hope that the granite would work with our color scheme. On the day of the actual installation, the vanity top was laid on the countertop in our bath. This was the same granite that was in the kitchen and not the white marble that was originally promised to me. Although I stressed over and over again to Andy how very important these choices were to me to be absolutely right since this was to be our very last home, I did not get anything that I originally wanted or chose. Immediately when I saw the brown granite vanity top in place, I told Andy and his installers that the color of the granite absolutely did not match the color of black tiles which we had just installed on the floor. I did not accept the vanity top and he indicated to my husband and I both his acceptance of this and his condolences that this did not meet our requirements. As stated over and over to Andy in many conversations, I had told him from the very beginning that we had just installed a black granite tile floor in this bathroom and the vanity top must be a white marble or perhaps even a black granite might work if he would not supply the white marble as that was the only other color which would match the floor. After I told Andy that the vanity they had brought would absolutely not work with our color scheme he assured me that he would handle everything and cordially took the vanity with him. I paid him the entire fee of $2,650.00 in CASH and I assumed that we would work something out because he had stated during this installation of our kitchen countertops that he had another job coming up within a day or two where he felt that perhaps he would be able to furnish me a black granite top since he did not feel he could purchase the white marble I had originally contracted him for. He led me to believe that there would be no charge for his doing this or at least at best perhaps a very minimal charge to replace the unwanted countertop. He did not state nor discuss that I would owe him additional monies and he led my husband and I to believe that he would make everything right. We even discussed on that day that he could perhaps put the granite vanity he had made for our bathroom into his showroom and sell it quite easily there because it was somewhat of a neutral brown which many people might be able to use. The installers took the vanity top with them and Andy said he would make it right and would contact me by phone by the end of that week. I waited for over a week and even after moving into our new home, with no vanity top installed, still expecting Andy to call us to schedule an appointment to discuss the installation of a white marble vanity top or at the very least, his supplying a black granite vanity top. After having no contact from him, I phoned him and asked for him if I could meet with him the next morning to discuss how to proceed. The next morning, Andy basically told me that the vanity was mine and unless I was willing to pay him an additional $450.00, that he could not help me any further. I left his business in tears without the vanity and not knowing what to do next.My husband also went to talk to Andy on this same day and was told that .......................... Needless to say my husband and I are very dissatisfied and would like to have the products that I originally contracted and that I paid for.
Description of Work: I contracted to have granite kitchen counter tops made from a granite slab that I chose and a white marble first floor vanity top installed. What I got was a different granite than the one I chose for the kitchen and a granite vanity top for the first floor bath, not the white marble I paid for. Andy will promise one thing and then deliver something entirely different.
