The UK’s Insurance Act 2015, effective since August 2016, benefits insurance buyers by providing them stronger positions in claim negotiations. Despite this, it hasn’t significantly reduced litigation in a challenging market. According to Rob Smart from Mactavish, while the Act has led to fairer claim resolutions without court involvement, it hasn’t cut down disputes. Mactavish research shows litigation to recover rejected claims has tripled from 2018 to 2022. Fenchurch Law also reports no reduction in disputes, with insurers adjusting their arguments to fit the Act. The Act, though complex, helps buyers by requiring insurers to prove the sufficiency of their underwriting, leading to more balanced outcomes. But, areas like warranty and marine insurance often bypass the Act’s rules, which can still leave buyers vulnerable.
